    The TEC are processing my forms at the moment but out of interest, I've been doing some digging on JBW.

    They claim to have sent a bailiff on the 5th January and gave me the justice.gov website to check out his certificate. Turns out he doesn't have one! What are my rights here?

    The earlier bailiff visit was on the 20th December and apparently a different bailiff was sent.
    His certificate was not granted until the 10th January this year. It could be possible he had a certifcate covering the month before but anyway of proving?

    I asked for copies of the documentation of both visits as I've had none and this is JBW's reply!

    JBW Group are unable to provide the actual documentation that was left at your premises at this is not systematically produced, it is handwritten at the time of the visit however if you would like to see a template of what the letter would look like we are able to provide this to you.

    Although my case is on hold, this company are so dodgy it's unreal..

      None I'm afraid.

      If the bailiff absconded with any money collected, the council would have a problem because the bailiffs insurance policy is invalid.

      They admit they can provide it, but didnt.

      You can now disregard any fees because they are unable to show compelling evidence the work has been done. See Point 3 http://www.legalbeagles.info/forums/...ad.php?t=32484

        In addition to reporting JBW to the OFT and Trading Standards, I would also report them to the police. What they are doing may well amount to a breach of the Protection from Harassment Act 1997.

            For some reason, whenever bailiff crime is reported to the police, it is nearly always dismissed as a civil matter, no crime number given, no investigation, nothng. And that policy applies to all police forces, which suggests the policy originates from ACPO or other crime policy unit within Government.

            I have put many complaints to the police for debtors, but each time they get a personal visit from an Inspector who refuses to crime it.

            When a case is heavily weighted with evidence, such as video and witnesses, the police acknowledge the crime only if the IPCC are called to intervene after a complaint is made for committing an offence under Section 4 of the Criminal Law Act 1967, but the reason for not charging the suspect changes. The case does not fit the criteria to be passed to the CPS. That "criteria" has never been explained.

            Its just easier for the debtor to seek a civil remedy.

              Section 4, Criminal Law Act 1967 deals with aiding and abetting an arrestable offence. However, be aware that it has been amended by a number of enactments since coming into force.

              What you describe about the attitude of the police smacks of masonic influences at work or, more likely, a neo-Marxist group called Common Purpose that has infiltrated a number of the 43 police forces in England and Wales. If you go onto YouTube, put "Brian Gerrish" into the search engine and watch the videos, you will see what I mean. The fact that an inspector turns up and not a constable and the police only get themselves into gear when the IPCC intervene tends to make me think this is what is going on. Also, changing the reason for not charging suspects and then claiming a case does not fit the criteria to be passed to CPS, but never explaining the criteria, is a known Common Purpose tactic.

              With regard to civil remedy, there are civil remedy provisions contained within Section 3, Protection from Harassment Act 1997. This enables an injunction to be obtained from a County Court or the High Court, depending upon how serious the harassment is, and served on the defendant. If the injunction is then breached, the plaintiff can then apply to the court for a warrant for the arrest of the defendant. Please note that an arrest warrant is an order of the court to the police to arrest a person and bring that person before the court to answer whatever is detailed on the warrant. The penalty for breaching an injunction under the Act is a fine of up to £20k or up to 6 months imprisonment or both on summary conviction, or an unlimited fine or up to 5 years' imprisonment or both on conviction on indictment. In this respect, a civil remedy is more effective and the police cannot wriggle out of it.

                  Hi everyone,

                  Thanks for all the advice so far.

                  My appeal has been rejected today by Sutton Council

                  The council website has allowed me to make full payment of the PCN (£157) which I've done despite the manager there telling me I have to pay via the bailiff.

                  What would you advise I do re JBW?
                  I no longer have a car and live in a secure entry block. Is there anything they can do legally to get in and take my things?

                  Their fees now equate to £587 minus the £157 I paid today...

                    Tell the bailiff company the PCN has been paid in full. The next question is, "Are the bailiff company's fees justifiable or, for that matter, lawful?" There are LB members who are well-versed in bailiff fees or go onto the "Dealing with Bailiffs" forum.

                      The bailiff cannot collect his fees if you have paid the fine, nor can he sue you for them
