Thanks a lot.
The original fine was £120 I believe (would have been £60 had I paid within 14 days)
JBW say I owe £537 but will not give me a breakdown over the phone.
To date, I've had 5 text messages saying the account is 'due to be issued to a bailiff' and one letter.
I can't see how that adds up to £537 so I'd be really grateful to hear what it should be.

Have you phoned the TEC to see if you case is still open?

If its closed and settled then the bailiff is adding more and more fees for as long as you keep paying. It seems the bailiffs have been taking you for a ride over a long period of time.

Also phone the council, and see if their records show the case as paid. Show evidence you have paid the ticket plus the statutory fees. If they dont, then make a formal complaint in writing to the council, then escalate your complaint to the Local Government Ombudsman.

You have paid well over the amount the law says you have to pay.

Assuming no distress took place and no goods levied, the only statutory bailiffs fees you owe is £29.10. The £11.20 letter fee only applies if they can show evidence it has been done.

Remember, if you decide to litigate, its the COUNCIL you are litigating, not the bailiff. The bailiff is the councils problem.

OP - if you e-mail the CEO of the council and mention vicarious liability, enclosing proof of what you've paid, I suspect they'll back off.

I remember. You waged a long and protracted vendetta on JBW across many forum sites.

If you disagree with what Medway council is doing with taxpayers cash, then become a councillor. Once you get your seat, you get invited to all the tea parties sponsored by prospective contractors, including JBW, and you can tell them precisely what you think of them.

The CEO most definitely does work like that. He did over 70 times last year alone for me! Obviously it takes a little more than the mention of vicarious liability, but they don't like threats of litigation, especially if they can see that you may well win.

So I have received the breakdown from jbw -

Debt - 157
Letter fee - 11.20 + 2.24 vat.
Attendance to levy 1 - 48.00 + 9.60 vat
Attendance to remove - 175.00 + 35.00 vat
Attendance to levy 2 - 58.00 11.60 vat

Just to confirm, I've had 5 text messages. The last one on monday of this week saying my account was 'due' to be issued to a bailiff and one letter dated 5th jan.

Can someone pls let me know what to do next?

The tec forms have arrived today so I will complete them ASAP..
In case I wasn't clear in my original post, I appealed the decision with Sutton council and had no response.

If the appeal has been lodged, that stops enforcement. If you appeal succeeds then you dont need to pay any bailiffs fees at all. The case will be rolled back to the original PCN payable to Sutton.

Keep copies of your completed appeal forms from the TEC. Phone Sutton and be sure that enforcement action has been ceased.

Has any bailiff actually turned up?, if not, then the bailiff is guilty for charging for work he has not done. See http://www.legalbeagles.info/forums/...ad.php?t=32484 Point 7.

Thanks. The bailiff hasn't turned up that I'm aware of.
I no longer have the car so theres nothing to take.
Are these fees correct based on that?

If no visit has been made, then the only fee is £11.20.

To be honest I wouldnt even bother with that, because the bailiff is taking you for a mug.

If you know the bailiffs name, then I would make complaint to the council that issued the ticket. If the council fobs you off with contact the bailiffs, then stick him on a Form 4. that'll give him something to think about.

No, I've seen the bailiff. The attendance to levy 1 and attendance to remove are on the same day? I'm sure this can't be right?

The law doesnt provide for either fee, its bailiffs adding fees indiscrimately. I wouldnt be concerned with bailiffs fees because you are appealing the PCN.
