    Hi, can somebody advise me please. I have today recieved an eviction notice at the local court and it is for 22nd december 2011. that is two weeks today. I have got rent arrears and the landlord was making personal threats to myself, he never gave me an oppertunity to arrange repayments of the arrears. I informed the judge of this today but he said it was irrelevant to the case and went ahead with the notice. Also on the form it asked did i have a property that i could move to and i ticked the box stating yes but the property would not be ready till mid january but even this was not taken into consideration. We have got a 5 month old baby living with us and feel that maybe we could have been given time till our new house was ready. Do you think we have been treated fairly. Thank you.

    I believe that, in certain circumstances, you can apply to the court to delay the eviction.

    You may find that you need a little extra help, so it might benefit you to contact Shelter

      If you have not left once the date given in the possession order has passed your landlord can apply to the court for the bailiffs to evict you. It usually takes two to four weeks before the bailiffs come to physically remove you from the property, but you may only get a few days' notice.

      This will take you to the Mid January at least so you should be safe.
