  • Rossendales charges

    Hi,

I had a visit from a Rossendales bailiff yesterday, stating i owe them £120 in missed council tax.

I was on a payment plan, which I think was nearly paid off (possibly £50 remaining) which they never chased. SO im wondering where the additional charge of £70 has come from. Does anyone have a list of charges a bailiff can legally add?

I have requested all payment info and charges from rossendales (yesterday) but I presume they will take a day or two to get back to me.

he did make a big fuss about it being 24hr notice, bet then said maximum i can allow is 7 or 10 days? As for most money is tight and I dont have £120 lying about to just give over.

    any help appreciated.

Was your payment plan with the Council or the Bailiffs.

If it was the Bailiffs you need to send a request for a Subject Access Request, plenty of info on this site. Legal Beagles Consumer Forum

Charges for Council Tax can be found here;- Council Tax (Administration & Enforcement) Regulations 1992 Schedule 5 – Charges Connected with Distress – Regulation 45

Post 3 has charges. If you're in Wales they're slightly different, but not significantly for 1st and 2nd visit charges.

As said above, if you want a detailed breakdown you'll need to send an SAR - click Bailiffs tab and you'll find a template SAR in there.

Had a breakdown of costs from Rossendales, indeed I had £50 outstanding and they charged me £70 for van attendance?

I find this absolutely scandalous is there anything I can do? I have since paid of the £120 (50 & 70 charges)

Did a van actually attend? If so, you won't have mh chance of getting the charge back. If not, then you must challenge it.

Have a read of this Bailiff Guide - Legal Beagles Consumer Forum

Now that you have actually paid the charges you will have a fight on your hands to get them back so you will need to persevere with it.

              Re: Rossendales charges

It was a knock at the door and a rental van over the road, I presume that must have been it.

I will complain to rossendales regardless as they never sent me a letter to say there was still £50 outstanding, it went straight to bailiff. If they had sent me a reminder I would have paid it.

              thanks for the reply

                Re: Rossendales charges

Do they have a Walking Possession Agreement, as I don't think they can charge a van fee without one.

They can also charge £12 for making a Walking Possession Agreement and, if you have not kept to the agreement, they can charge you for hiring a van to take your belongings away. This must be in line with normal van hire rates. Bailiffs cannot bring a van to your home and try to charge you for it before they get a 'walking possession agreement'
Not sure if this is 100% accurate though. Others will more knowledge may know.
