Help With Bailiffs Please

Hi guys, I am new to all this so please forgive any errors.

I have a bailiff chasing me for two pcn'S (Parking Charge Notices -I believe this is correct!). I am not disputing that I owe them or anything like that and I am quite aware they need to be paid. However, my problem is quite simply that I can not afford to pay them all in one go. They total together nearly £1000. I have tried to make arrangements to pay but I hit a brick wall every time. I have been to my local council who agreed to accept a payment plan and they notified the bailiff they were happy to accept it. However, the bailiff refused it. I went back to council who told me the bailiff was in his rights to do this. I tried the bailiff company who said it was up to the individual bailiff if they were happy to accept a payment plan so they were of no help.

I really am at the end of my tether, I can not afford to lose my car as my Son has health problems which may require immediate medical attention although it may not be an emergency so I need to be able to get him to out local hospital or to a London hospital straight away. I have been trying for nearly a year now to get this sorted but I am having no luck at all, If they had accepted my payment plan this would be nearly cleared off now.

Is there anything I can do to stop this or arrange a payment plan? The bailiff can not be the end of the road can it? I have contacted Northampton county court where the warrant of execution was issued but they too said it was down to the bailiff.

I have recently become a single parent so it is even more important that I get this sorted, I don't want to be afraid to answer the door anymore. I really am at the end of my tether with this and I just don't know what to do, can someone please help me

Not an expert on Baliffs however, have a read of this. If you're offering to pay then the council and the bailiffs should by rights accept your offer as long as its reasonable.

Balliffs cannot enter you're property unless they have a warrant from the courts, so refuse entry until they show you one. Has one of these been granted?

I'm no expert either, but being a single parent you are considered to be 'vulnerable' under the National Standards of Enforcement agents 2002, you need to inform both the bailiff and the council of this and the Bailiffs should send this back to the council. Heres a couple of letters you may wish to use or adapt

To the council

Dear Sir/Madame

I write with reference to the Penalty Charge Notices number XXXX and XXXX issued on XXXXX and XXXX respectively.

Despite agreeing a payment plan with yourselves I have received a visit from xxxxx Bailiffs on [Date] attempting to recover £xxxx.

I have disputed the amount due with the Bailiffs to assess what additional charges they have imposed.

I wish to advise you that as a single parent I am a vulnerable person as defined by national standards of Enforcement agents 2002 , additionally my son suffers serious health issues as such you should consider alternative collection methods to Bailiffs. I therefore request that you revert back to the payment plan agreed previously of £xxx per week/month.

Thank you in anticipation of your co-operation.


....And to the Bailiffs

Dear Sir/Madame.

I write with reference to your recent attempts to recover £xxx on behalf of xxxxxxx council for two penalty charge notices numbers xxxx and xxxxx, your ref xxxxxxx

Could you please provide a complete breakdown of the amount claimed, including any charges added by yourselves listing each charge separately, you should consider this debt in dispute until I have been able to establish if fees have been added in accordance with regulations.

I wish to advise you that I am aware of both my rights and the regulations and guidelines which govern your practices and accordingly inform you that no representative of your company will be given peaceable access to my property. Given that you have been give notice I will not be liable for any further charge from yourselves resulting from you ignoring this notice.

I also advise you that I am considered a vulnerable person under the National Standards of Enforcement agents 2002.

Further, my son suffers serious health issues which can require immediate treatment. Given that you are now informed I will hold your company and the individual Bailiff personally liable for any complications that may arise from not being able to transport my Son for any treatment in the event of any levy being placed on my vehicle.

I will not hesitate to make a formal complaint to the court who issues your license should you pursue this matter in a manner that is not consistent with regulations/guidelines.

No doubt there are lots of charges imposed by the bailiffs which may be reclaimable. When you've had a read of the Parking Guide ome back and post any more questions. In the meantime, I've reported your thread to get it moved to the bailiff forum, where it will get more attention.
