  • marston final notice

    Hi all,
    Before I unravel my woes , may I just say what a relief it is to find this forum and the no-nonsense advice regarding bailiffs.

    i have had a 'final notice' letter put through my door today from Marston group saying that they are to execute an arrest warrant because of unpaid fines. Now I have fallen behind with payments regarding a tax disc car crushed fine, I have had no letter stating that the baliffs were coming round. It says if I do not contact the warrant officer will leave me "liable to arrest at anytime by the agent or by the police".From what I've gathered from the net;
    -The 'enforcement officer' is indeed a registered bailiff.
    -I can't be 'arrested' by this bailiff because he simply doesn't have the legal powers and the police can only turn up if the situation is of a breach of the peace nature.

    I 'm off to the CAB to sort this out tomorrow.
    Any further advice from the forum please, Thanks in advance.

    Contact the fines office for the court and try to re-establish a payment plan.

    By the way, how much is the vehicle excise duty these days for a crushed motor car?

      It depends what sort of bailiff they are. If they are a Civil Enforcement Officer they have the power to execute a warrant of arrest for non paid magistrate court fines. As the fine was for a criminal offence, not a civil one, then I believe the police could also arrest you (not 100% sure so check!)

      Please post up what CAB advise - it will be interesting to know. Often they phone and ask for more time for you. I would post up here again before taking any drastic action.
