    Hi everyone

    Please could someone give me a little advice. On Thursday of last week a bailiff clamped and chained my car (which is on HP) and told me that he would not release the car until I had paid for an outstanding parking ticket, totally £605.00 (the original ticket being approximately £105). It was 7.45 am and I was not at my best and panicked, paid the bailiff £201.50 and agreed to pay £100 per week until the debt was settled, (an amount I honestly can't possibly afford, being a single mum, but panic and embarassment prevailed!).

    I have since visited my CAB who have given me lots of literature, mostly regarding the excessive charges being made by the bailiffs. I have e-mailed and phoned the bailiffs asking for a breakdown of the charges, which they have informed me are forthcoming (hard copy). I have called the Essex Parking ticket people and explained the charges that their agents (the bailiffs) are charging are ridiculously high and in no way reflect the original fine.

    I am now considering taking this to court as can see no other option. Has anyone else done this, and if so what is the protocol and what was the outcome?

    I really would appreciate any advice as feel I am little fish against Orca!

      Is it lawful for a bailiff to clamp or immobilise a vehicle that does not belong to the debtor?

        Yes, if it is parked unlawfully. Legislation came into force under an SI in England on March 31st 2008.

          And in this case, where the hired motor-car had not been parked unlawfully at the time it was immobilised?

            They can immobilise it as part of the levying process. If it is on HP, then it is up to the debtor to prove they do not own the car.

              That should be simple enough - just shew them the HP agreement.
