  • marston threatening for some elses debt

Thanks Casper for helping with my senior moment .
Hi folks any one got some good advive.
I've had a letter from marstons for one of my former lodgers.
This bloke was caught riding a pushbikeand jumping a junction (failing to comply with a trafficsign ).
Said former lodger is a Colombian national and has returned to Colombia.
    Fees £75
    Fine £45
They have a magistrates warant for the above amount .
I've tried ringing and telling them he's not there and they said email so i did that over a week ago and they haven't even opened the e-mail . Rang again got a different email address so sent letter again .

    My questions are .
Do they have the right to ask for proof of my identity as a bill payer at the house?
Will the police attendif they try to make an illegal levy.
What should i do if the clamp the car? as I have no money to apy for it now and then argue later .
They have refused to give any information about the company over the phone including their registered address, and the name of their date controller .

Any help and advice geartfully recieved from beagles
What should i do if they turn up i have 8 tenants most of whom do not have English as first language.

Have you only dealt with Marstons so far?

The first thing I would do is go to or phone the magistrates court expressing your concerns and seek their advice on what you should do. You are not liable for somebody else's offence, and just because you happen to be the landlord makes no difference.

If you get no joy there, have they actually mentioned doing anything to you? If they haven't I'd be inclined to send the letters back saying "No longer at this address" rather than trying to intervene on this blokes behalf. It is really nothing to do with you, you just happen to be the landlord. I honestly don't think you have anything to worry about.
