  • Council Tax Bailiffs, Flat Mates Car and Bankruptcy

I have been reading much of the excellent advice here but just have a couple of questions.

I am saving up for Bankruptcy (hopefully within the next couple of weeks) and so have stopped paying an arrangement for Council Tax arrears with Equifax after my account got passed to bailiffs.

I Share a flat with someone who I have NO fiancial links to.

My flat mate has a car in our parking spot... how can I stop the bailiff taking her car?

Once the bailiff visits (I have only received letters in the post so far stating they will visit) how soon will it be for their second visit?

I understand that for council tax debt even once bankrupt a bailiff can still try and visit is this right?

    Many thanks for the help!

The bailiff can only levy on goods belonging to the debtor and the debtor is who is named on the Liability Order.

However, if it reasonable for the bailiff to presume the car belong to you and levies on it, then it would be up to your flatmate to prove the car is hers, it would not be for the bailiff to prove ownership.
