My son received a Distress Warrant from Phillips the Bailiff's asking for £175 in respect of an unpaid magistrates fine . He was found £300 with 3 months to pay. He paid the first £100 by cheque , he was given a written receipt, (which he cannot find) at the court on the day of conviction and paid the remaining £200 by two installments into the machine in the court.
The original date of conviction was June 2008, the bailiffs letter arrived in March 2011 saying that he owed £175.
On checking with the court system they advised him that he had not paid the first £100 and had written to him in January 2011 advising him of this and then passed tp Phillips,he did not receive this letter.
We have checked his bank statements for this period and it looks like they never cashed the cheque.
Again in contact with the court system and advised to go to magistrates to get the warrant withdrawn, he does not dispute that he now owes the £100 but the fact that a bailiffs letter increased it to £175.
Got to magistrates and clerk checked with central accounting who said he could not challenge it.
I have now paid the fine under protest but would like any advice if I can take it further.
