    Hi I wonder if anyone could clarify things for me.

    My wife was caught by a speeding camera last year on the M1 and we failed to notify them of the driver in time. As a result she was taken to court in March for failing to name the driver and ordered to pay a fine of around £600 and got 6 points on her licence.

    I don't remember getting a letter about this and we didn't have to send her paper counterpart off. It was only when we got her counterpart re-issued for a further speeding offence we remembered the date of conviction and subsequent fine.

    However, Phillips Debt Recovery agents have since sent a letter through the door stating
    "We are in reciept of a distress warrant for non-payment of magistrates fine" and they have been ordered to execute the warrant.

    They are demanding (in bold) full payment of the outstanding amount of £700 within 7 days or they will remove goods from our property.

    If we fail to settle £700 IN FULL they will

    1) Add £200 attendance fee on when they attend
    2) Force entry to exexute the warrant under the DVCV Act)
    3) Remove goods and our car and sold at auction (£200 plus storage costs)

    What are our options? We're in financial trouble as it is and can barely afford to pay the mortgage without this coming along?

    I've heard that for magistrates fine they CAN break into your home.... are we too late to pay by instalments? Can we get means tested to prove we have about £30 a month disposable income?

    You need to have a read of this guide Bailiff Guide - Legal Beagles Consumer Forum if you have not already done so.

    You need to contact the Fines Department of the Magistrates Court to arrange a date when you can attend for a Means Enquiry Hearing.

    You will be required to complete an Income & Expenditure form in order that the Magistrates can agree repayments at an affordable level.
