  • Rossendales - can't be legal

    Hi,

My husband and I got behind on our council tax but have since paid what we owe direct to the council. However, the bailiffs still want their fees and will go to any lengths to get it.

Two weeks ago my daughter called me at work extremely upset (she is 17). She answered the door to find a man standing there with a clipboard. He asked for either myself or my husband by name. He said he had been sent by the council to discuss something with us.

She told him we were both at work so he asked if he could come in and discuss it with her. At the time she was in the house alone and still in her night clothes, not to mention she is still a minor. She was terrified and slammed the door closed and locked it. She then phoned me very distressed.

I contacted the council to try and find out if this was the bailiffs but they have denied it. I asked for a quick response because I felt this was totally out of order and if it was not them I should contact the Police. They did not respond quickly even though I thought this was a matter of urgency and when they did, all they wanted was their money and they said they had only called at the property twice but still want £182. They also said that they had called at the house before and could hear us moving around inside but we didn't answer the door. This is a total lie because we both work full-time and the kids are generally at school/college.

I do not believe them because no-one else on our street had anyone knocking on their door, the man asked for us by name and they made no mention that this was bad practice and they would never do something like this. It took them over a week to even deny it was them.

Do you think I should contact the Police or is it just our word against theirs?

I would be grateful for any advice.

    Regards,

    Sam

In the bailiff guide you will fine a link to a Subject Access Request Bailiff Guide - Legal Beagles Consumer Forum you should send this and see if it shows the visit they made when your daughter was alone.

The National Standards for Enforcement Agents, under the category of 'vulnerable situations' states the following:-

"Enforcement agents must withdraw from domestic premises if the only person present is, or appears to be, under the age of 18; they can ask when the debtor will be home - if appropriate."

As for the fees, if all they have done is visited you twice, then the maximum fee is £42.50. So you need to ascertain how they believe £182 to be correct.

Did they leave you any paperwork when they visited you?
