  • Jacobs Bailiffs - No letters Received

    Like so many, I have had difficulty this year paying my council tax and in September my council transfered my debt to Jacobs after being told by the council they would be in contact. I never received a letter from Jacobs so early October i called them to enquire about this. They said they had sent 2 letters, so I checked the address and all was correct. Over the phone they said I owed £978 and must either pay in full there and then or I could make 3 monthly payments. Otherwise they would arrange for a bailiff to come to my house and take items. This scared the hell out of me so through a family member I arranged to make the 3 monthly payments starting in October. I received a letter form them confirming this.

    I paid October and November on the date agreed, however I paid the final amount on 5th Jan rather than the 15th Dec. I did this by automated service over the telephone. No receipts have ever been received although I was told they would be sent at the start as I wanted to ensure I had no problems.

    I came home last night to find a hand delivered letter through my door saying I owed £95.51 and to call the number on the letter or face items being removed the following day.

    I called the number and spoke to a man who was not very nice and said the amount was for a court summons of not paying my council tax. I didn't understand as I had paid in full by 5th Jan for this financial year and owed nothing.

    He said 2 letters had been sent to me which I had ignored. I honestly had not got them. If I did not pay there and then he would come again tomorrow which would cost an extra £18.00 and take items.

    I said I wnated to speak to someone and he said the office was closed so I could only call on Monday. Left with no option and not wnating to pay an extra £18.00 I paid over the phone.

    Do Jacobs ever really send letters when they say they have so they can charge you more and also, what is this £95.51 for??? I really need some advise before I take it up with them on Monday and also what is the best way to do this - in writing or over the phone??

      what council is this

      do everything by e-mail or letter don't speak to them over the phone(unless you can record the call)
      get in touch with your council and find out the amount of the liability order ask if the council charges for the liability order are included (they should be)

      has the bailiff levied on goods and left you a notice of seizure of goods and inventory
      how many hand delivered letters have you had from Jacobs

        Warrington Council.

        No iventory list has been left and I have had only one hand delivered letter - the one from last night.

        The £978.00 was what I owed the council for the period 01Apr10-31Mar11 and this was paid in full on 5th Jan. I have never been made aware of any other charges.

          I have contacted the council and the replied as follows:

          I can confirm that the Liability Order was issued to the bailiff for £968.42. I can confirm that a payment of £285.97 was received, followed by two payments of £328.47. I can confirm that the Bailiffs total fees were £97.50. However, they have now confirmed that the balance is paid in full.

          It appears the first payment to the council was under what I had paid, then this fee of £97.50 that I have never been told about. The council said for me to contact CAB but they are so hard to get hold of.

          Can anyone help with this?

            These figures do not add up. The bailiff, unsurprisingly, says you owe more than the council say you owe.

            The council say the amount outstanding was £968.42.

            Then the council confirm the amount of the LO and that you made payments totalling £942.91, but also state the balance is paid in full.

            You need to find out exactly what is going on here and I would suggest that you do that by sending a Subject Access Request, which you can find here Bailiff Guide - Legal Beagles Consumer Forum

            I honestly have no idea why your own council is referring you to the CAB when they should be the ones to help you. Clearly, they do not know what is going on either, but just pretend that they do.
