  • Judgement for claimant?

    can anybody help me pls friend of mine got the letter from court (Blackhorse) and would like to know if it is real or not. also apperently they told her if she will not pay they will go into her workplace and will take 200£ of her wages.are they allowed to do that?

    I will scan the Judgement for Claimant for You to take a look at.

      because she has never been to court but getting this letter right away. yes it is her debt.

        The Judgment says she did not respond to the claim - did she not receive the N1?

        Has she been paying this? How many, if any, installments has she missed?

          she said she had written to the court (N1) but answer never came back only the notice. she missed a lot of payements because in her family everybody lost their jobs last year and she only started to work in January 2011.

            I think you need to find out a lot more information from your friend.

            The N1 is the claim form from Black Horse that she would have needed to respond to within 14 days. So do you know if she acknowledged the claim and subsequently entered her defence?

            What did she write to the court? What notice came back?

              as far as I know citizen advice helped her reduce the payements in march 2010 to £1/month due to hardship, which suposed to last for a year. she said in January she had this court claim from black horse which she responded to but received no answer, only the judgement.

              but to be on the safe side I will ask her more about this and will come back to You

                she says she received the letter from BH within an 'Application for suspension of a warrant and/or variation of an order' which she send back within 14 days, but no other response came back than the Judgement for Claimant.

                  she has got a payement protection plan in her agreement, does that mean she can claim ppi/

                    if there was a PPI on the agreement with Blackhorse is it possible to claim PPI even if there is judgement made?

                          she just found out she has got PPI on her loan agreement which she has been paying every month since opening the account with the monthly instalments. so if she had paid why did the PPI not paid for those month she was unable to pay due to unemployement?

                          can she defend her case using this argument or is there another way?because she states that she had filled in the 'Application for suspension of a warrant and/or variation of an order' - what she received with the first letter- than send it back to the recipient, but only received the judgement.

                            PPI is usually a single premium product, so if any payments are missed the policy should not be cancelled. It is only the credit that was advanced for the PPI that has not been paid. To answer your question the PPI does not pay out unless a claim is made under the policy, unless Black horse do it differently, and I don't think they do.

                            Your friend I think needs to have the order varied to a sum she can afford, so that will mean a visit to the court I am afraid.

                              I was affraid from this answer ..... so there is no other option but to write to the judge and this time with a proper proposition to vary the sum with an income expenditure sheet?

                              is it possible to claim the PPI now, or is way too late.

                              also blackhorse put her in contact with Eurodebt financial services who told her if she pays them £100 they will pay BH £50 each month, take £30 to themselves and £10 for 2 other credit cards. so why is BH not accepting her proposition paying £50 but agree with debt services to do so?
