hi i would like to know what action i can take against a debt collector from the phillpips debt recovery. today i recieved a call at my house at aprox 8.35 but i had walked to school to drop my kids off. i left my car parked in my drive. i returned home only to realise that my car had been clamped and a sign saying do not remove. i went inside and saw a letter that had been paosted asking to pay £645 for outstanding pcn's under someone elses name. i called them and informed them that i had just moved into the property and that they had wrongfully clamped my car. they replied we have spoken to the neighbours and asked them who lives at the address and we are sure that the person that owes the unpaid pcn's is me. i told them my name and told them i would provide proof if they came back. after 3 hours of me calling they returned and saw my id only to relise i was not the debtor they were looking for. i asked them why they clamped my car with out giving notice or letters prior to this visit, and they replied we asked the neighbours, and the told us that a young women lived at the adress. im not sure if they can ask other people about someone they are looking for. is that not breach of confidence. my ex prtner was at my house so he went out to ask them to put the wheel trims back on like they removed them and the bailiff started to abuse him, and really intimidated him to hit him, but luckly my ex partner stayed calm because our lil girl was stood there. the bailiff then went on to swear and say racist comments like you lot owt to go back where you belong, you pakis. i was very shocked at the comments made by the bailiff and called the police. they responded straight away but the bailiffs had left by then. as i was talking to the police the bailiffs returned to make up a story about me owing the pcn and them clamping the car when the fact was that the fine was not mine and the car was not the one that the pcn was isssued against. i want to know what steps i can take to report this disgusting behaviour of the bailiffs and whether i can claim for mental distress

When you say 'just moved into the property' how recent are we talking? Had there been any correspondence addressed to the previous owner/occupier?
You need to write down exactly what happened, as you have above, but a full and proper version. Verbatim.

i moved in around december 2010. there were afew letters in the post under previous tenants name which were sent from royal mail saying if your not the adressee return. so i returned all corespondance under previous tenats name and told them that she was not living at this adress. but i know from what my neighbours told me that the bailiffs have been around sevral times at my house and i was not in so they asked around about the previous tenant and then left with out leaving any letters wot so eva about calling them or telling me that they had visited. the first i knew about any debt was when the had clamped my car.
