    hi im a newbie here and need some advice ive read through some of the threads and im very impessed
    ive just had a swift credit agent call at my house after i recieved a letter on jan 6 2011 informing me that i owed £127 for what i didnt know. so i went to court and asked them to reopen the case apparently i got fined for not wearing a seatbelt

    so i called them back to make them aware the case was being reopened

    then tonight agent A**** *****S arrived at my door without any paperwork demanding £370 pounds or he was emptying my house and the van was on its way which would inccur me extra costs off £300+

    he tried to get into my house by saying its cold outside lets go in whilst you ring your friends to raise the money and lets go inside to have a look if you have anything worth taking

    i refused to let him in due to the fact my 2 young children and the neghbours kids were eating there tea and my girlfriend (6 months pregnant) were there
    and i felt quite intimidated, he refused to give me any paperwork or show me any id

    when i refused he started trying to push past me and gain entry to my home
    i told him to get out of my front garden he refused i eventually made him leave the front garden where he stood for over a hr remindng me politely that three hefty lads were on there way and they would legally force entry into my home and empty it beds everything

    i explained most of the stuff in the house belongs to my mum to which he replied you better ring her to explain shes going to lose all her stuff unless she can lend you £370

    he told me if i could get £150 today before the van arrives i could pay the rest in instalments so i rang her and she agreed to pay the £150 he gave me the referance number and telephone number for her to ring and pay it

    she rang up to pay the agreed £150 and theyve taken the full £370 ive been left with no receipt my elderly mother is now in debt and i feel thoroughly violated

    is any of this even legal

    Is this person a bailiff? Or purporting to be a bailiff? Either way, you did the right thing by not letting him in. Under no circumstance let anyone like this over your doorstep. If he or anyone else calls again don't even open the door, if you do feel the need to speak to them do it from an upstairs window. If he is a bailiff there are strict rules that they have to follow, which of course they hope you don't know. Threats and bullying such as this are certainly not legal and are against all debt collection guidelines. If he isn't a bailiff the same applies, only more so.
    Have a look at the Bailiffs Guide in the Bailiff Forum, sorry I can't do a link at the moment.

    They have acted illegally by taking the whole amount from your mom's card, ring the bank immediately and see if you can reverse the card payment, tell them it was taken by fraudulent means, etc etc.

    Don't speak to the company over the phone, put it all in writing to them and I would also consider informing the police. Certainly contact the Court tomorrow and inform them of the actions taken by this bailiff and see what they advise. Did the bailiff give his name?You should consider making a Form 4 complaint.

    Sorry if this seems a bit garbled, you really need Amy, I'm sure she'll be along soon and will advise better than me. But in the menatime have a good read of the bailiff guide, which will make things a bit clearer.

      thank you i shall have a good read of that now

      im not sure he briefly flashed a card infront of my face i barely managed to see his name and the picture looked nothing like him

      it could of said he was allowed to sell ice cream for all i know

      im worried someone may have been through my bin and scammed me completely

      all he showed me was a document on a phone
      i felt that threatened i just wanted him away from my house and my family he said the money hadnt been authorised and she had to ring up and make another payment
      then refused to give me a receipt and started saying the lads are just round the corner if she doesnt make another payment immediately they could start emptying the house
      i said i was ringing the police and he said if the payment hasnt gone through by 9 am tommorow hed be back and just walked off

          How did you recieve this fine? These fines are given by police officers at the time of the offence.

          If it was not a police issued fine, who gave you the fine?

            well if this isn't a stupid question, surely if you'd been fined for not wearing a seatbelt you'd have known about it? As these sort of fines are "on-the-spot" fines aren't they?

              Hi. The fine for not wearing a seat belt is £60 and is on-the-spot. I would doubt very much this guy is a bailiff, if he had been genuine he would have let you see his ID properly not wave it about. Definitely report the matter to the police and give a description of this guy along with any other information. This feels like a scam to me. It could be that there is a gang of them going round scamming people out of money.

              I hope you manage to get things sorted out ok.

                The person who visited you was an Enforcement Agent, although he behaved like a thug, because no one would know about the fine you incurred besides the Police, the Court and the Enforcement Agency charged with collecting the debt. Quite rightly if you said that he could take £150.00 but took £370.00 it is theft, write to Swift complaining, copy the Court, send everything Recorded Delivery
