    Personally, I would pay the council the instalments as requested, and fight the bailiff charges as a separate issue direct with Rossendales.

    The council will chase you till the whole liability is paid so you might as well pay it. But if you agree to the instalments then you MUST stick to them, likewise you must also pay the forthcoming year's liability and keep up to date with it, otherwise the council will resort to other measures to get the money, which could be attachment of earnings/benefits, bailiffs, etc etc, and if this happens then you'll be back where you started.

    Once you have got the SAR details back from Rossendales then you will be able to see exactly what charges they have applied and be able to challenge them if they are not valid charges.

    Sorry if this sounds a bit harsh but it's what will happen. Believe me I've been there done it myself.

    As for the threat of sending you to jail, this is complete garbage and Rossendales and the Council know it. It is an offence to REFUSE to pay Council Tax, it is not an offence to be unable to pay it.

      I made a payment to the council this morning before I received their email saying they have taken the debt back..

      So i certainly am prepared to pay it off, nver have refused, so I have the car back and I have the debt back with the councill last monday i would have taken this result with absolute pleasure.

      However, its the fact rossendales have £144 they havnt passed on to the council, from at least £725. They have not yet told me what these charges are for. I am trying to get a SAR done asap, but unfortunatley, Im that skint, I paid the council the £10 this morning that could be used for the SAR, Im just waiting for the next time I have the £10.. times are indeed hard..

      this is the findings of my complaints to rossendales about teh whole thing, including being told by the bailiff hes giving the details to court to so he can come with the police to arrset me for the 90 day prison term..

      My Findings

      The First Call Bailiff who initially levied on the vehicle has confirmed the Notice of Distress was left on 18th August 2009. The form you signed clearly explains goods listed were being held in a Walking Possession Agreement. Following receipt of all the required proof of third party ownership, the vehicle was released and the levy fee removed. Once an account is returned to the Council, it will be the Council’s decision on what subsequent recovery action is required in relation to your account.

      The Next Steps

      The bailiff has confirmed he is returning your account to the office. Your account will then in turn be returned to North Lincolnshire Council. Once your account has been returned to the Council, you will need to speak to them directly in relation to the payment of your outstanding Council Tax debt.

      I can confirm the complaint has been recorded at Stage 1 of the Rossendales’ Complaint Procedure. If you are unsatisfied with the way your complaint has been handled, you may take your complaint to stage two of the Rossendales’ Complaint Procedure, which will be addressed by a Team Leader or manager. Please provide a written response specifying your arrears of concern in order a full review can be conducted.

        " I have today spoken to Natalie Brookes at Rossendales who has dealt with your complaint and she states that they have £156.00 in cancelled fees that you have previously paid to them which are to be remitted over to us in the next couple of weeks to reduce your debt with us further. "


        This email from the senior recovery manager at the council has put this episode to bed as far as i am concerned!

        Had the car not been taken away, Id have not known about this 156 quid as its only from this forum that made me realise what my rights are..

        So from the liability of £711.80 after they took the vehicle, ( 490 of which the council had down as my debt) it now stands at £344 once they get the payment of rossendales.

        Had they not taken the car, id have probably paid the 711 to them over a set period of time, along with other charges they would have imposed, so it really hasnt been a very good outcome to them.

        Whether people think i should pursue further my complaint against the bailiff etc, but I have a bill thats £156 less than it would have been, I know if I ever get into any scrapes with a bailiff again exactly how both he should operate and more importanlty, how I should operate..

        I really wish it could have been avoided, my dad was the one who suffered most, but since getting help from here just over a week ago I have

        1) Had the vehicle returned
        2) All charges related to the account imposed by Rossendales lifted
        3) the council taken the debt back and agreed in writing to accept my offer of payments..

          I still think you should file a form4 complaint about the bailiff. Especially as you have recordings of them telling you they're going to come back with the police and have you sent to prison.

          Look at it this way.... If you complain then maybe you'll stop someone else going through what you've been through!!!

            Hi Ben,

            I know what you are saying. I have been basically dealing with this for over a week, not been able to concentrate on anything else.

            I started out a week ago on here angry and desperate to try and get my dads car back. It has been a terrible week.

            I am not in work and I havnt been able to look for work since this has been going on. I am totally skint and really need to now find a job.

            Now I have the car back and the debt is back with the council and the bailiffs charges are no longer on it, I want to put the matter to bed and concentrate my efforts sorting my life out. I have 2 daughters i see on sundays and i cant afford to take then out or so anything with them..

            My prioirty has now reverted back to making sure I get into a position where I wont deal with bailiffs again, but if i do i know how to handle them.

            So I will not be taking this matter any further, if he was done by the courts it doesnt change my own situation, my total efforts from now on are to myself and my family.

            If I didnt get the outcome I was hoping for, i would have done everything thats necessary.

            Sorry if the outcome isnt to everyones liking..

              Hi Mr H

              I agree what you say about humberside police and the baillifs. They a=call them round here blunderside police farce, i kid you not.

              For the sake of other people in your position in our area, please take the time to complain formaly through the council and baillifs. I know itrs a bother but its only by doing this that something will EVENTUALY get done.
              crazy council ( as in local council,NELC ) as a member of the public, i don't get mad, i get even

                Mrhopeful I am really pleased you got a result that you are satisfied with, like you say it's your dad that suffered the most.
                We try to tell people to go as far as they feel comfortable with these things, as not everyone can can cope with some of the things that have to be done, maybe when you are more settled yourself and hopefully in employment you may just like to kick their backside a little harder, but that is purely your decision.
