      Thanks Ben,

      Well I was hoping for any kind of encouraging news for my dad so I rang Rossendales to speak to Steve Crooks !! Without realising it I chuckled at the lady from the council when she gave me his name and said crooks is very appropiate, i must remember in future not to do that!

      Rachel from rossendales answered the call and asked me straight away am I ringing to pay the balance. I asked to be put through to Mr crook and she put me on hold and after a few minutes returned to me and said hes unavailable, but he will answer the fax (received from the council) in letter form, but he hasnt done anything about it as yet.

      But she will put a hold on it for 7 days .. ( I asked a hold on what and she said they wont do anything with the vehicle for 7 days..

      So right now, I am at the stage where I sent both the council and Rossendales an indentical letter, stating I want the car returning as it does not belong to me, along with the log book, I know the council recieved and faxed the copy to Rossendales but told me its their decision, Rossendales are now to inform me of that in letter form!

      I have also sent a letter today recorded delivery to the council with a receipt of the payment I made today inisting I will not deal or pay anthing to Rossendales anymore, let bailiffs enter my house, interact with thier bailliffs, so take back the debt and I shall continue to pay the council direct, at the weekly sum I stipulated.

      I havnt rang the council back Amy, like you have suggested, but only because my dad is not working tomorrow, I can ring her, whilst my dad is nest to me, and say exactly what you have said.. I will just say to her, my dad is here , the owner, and hes told me to do the following . .

      then read to her about the "ebfore action letter" . .

      IS that ok, I just think she will take me alot more sriously when for the first time, the owner of the vehicle will be in the same room as me, so they will know how angry he is..

      Many thansk, I am extremely grateful with your advice and I hope once the car fiasco is over, I can continue to stay here, get my charges etc looked at and then when thats done, I will certainly donate some of the money to help this site continue its great work..

                hi there

                i have a lot of experiance with north lincs and north east lincs council in relatrion to liability orders for councl tax and the baillifs. I have a current formal complaint into CIPFA on exactly this.

                the reason the council make you deal with the baillifs is because of a figure they have to report to the audit commission ( BVPI indicators 8 and 9 ) and they need to keep it artaficaly high

                Council tax complaint to cipfa Crazy Council mentions your council. the basic figures say

                NELC 11.36% of bills get LO 6.25 % get sent to bailiffs ( this i beleive is the hightest in the country by far )


                NLC 4.36 % of bills get LO and 2.69 % get sent to bailiffs

                ERY 2.93 % of bills get LO and 1.28 % get sent to bailiffs ( this is the averidge )

                Yet NELC and NLC reported a higher sucsessfull collection rate to the auditors for 5 years running.

                if the baillifs made you mad, wait till you understand wrerthe court charges that you get added on for the LO go.

                crazy council ( as in local council,NELC ) as a member of the public, i don't get mad, i get even

                  Crazy Council, I have had a quick look and to my untrained and novice eye, the council actually rely on it getting to court/bailiff stage in order to balance the books, a 100% compliance and payments on time by everyone would in fact be bad news for the council??

                              Your research into the ins and outs of council's C.T debt recovery procedures ultimately demonstrates that millions of residents, usually the poorest, are used to nudge up local authorities' C.T collection rates and at the same time profiting the Magistrates courts, council's and private bailiff firms.

                              It's interesting that the cost of taking each resident to court is only £3 and several hundred liability orders are typically processed in one go. (one signature of the 'justice of the peace' in a bulk liability order)

                              The whole process appears to be bogus. The summons documents appear not to originate from the courts, bearing no seal of the court or anything related to the court but a doctored signature of the 'Clerk to the Justices' that is obviously photocopied onto the summons or transferred onto it electronically.

                              If you look at the Magistrate’s Courts Act 1980, section 51 makes it clear that the summons is issued by the court. Similarly section 34(2) of The Council Tax (Administration and Enforcement) Regulations 1992 requires that a request is made to the court for the issue of a summons.

                              Council's issuing summonses on behalf of Magistrates Court's are committing an offence under the Magistrate’s Courts Act and the Council Tax regulations.

                                No, I was going to see what response I was going to get first on the strength of the recorded letters with the proof of ownership, what really annoys me is its not as though I didnt have anything to show the bailiff on Monday morning, he just point blank refused to see the log book, dismissed it..

                                But after the lady at the council today told me its down to Rossendales to decide, yet her tone was far different than Monday morning with me, she basically patronised me on Monday while the bailiff was here, but was totally different today..

                                However, due to the fact they still wont do their duty and actually demand the bailiffs to return the vehicle, my dad will be ringing the police in the morning and obtaining a crime number, after which i shall ring the lady on the council who ive dealt with and politely inform her my father has reported the crime of his vehicle taken without his consesnt and you will be receiving a " Before action letter" Amy has recommended, as earlier mentioned.. informing her I shall be naming her personally in the matter..

                                This will be done whilst my dad is in the room with me, as up to now thats not been possible..

                                Thats it really, i just hope I can stop my dad from losing his head when I ring up as I have never seen him so angry !!
