  • Bailliff and PCN

    Hi, My wife has rec'd a letter thru the door from Dukes Bailiffs with regards to an outstanding PCN. This was the first visit from the bailiff and they are trying to charge a visit fee(28%) and an attendance to remove fee(£140) for this? Are they allowed to charge for a removal fee on the 1st visit, and can they break into our home to remove goods if they have not been inside our home?

      Hi,

      Many thanks for the repsonse the original fine was £60 and issued by East Cheshire Council.
      Warrant of execution states that the amount due was £110

      Letter thru the door from Dukes on 1st visit was for £343.64
      I have rang them and they say this is for
      Initial letter
      DVLA Check?
      Visit fee & Attendance to remove goods - £208.73

      Can they charge for a vist and attendance to remove goods?

      I have read your guide but am unsure as to the part where they can enter the property without gaining peaceful entry first? I thought that they could only do this if the fine is of a criminal nature? and not for PCN?

        If the only contact you have had with the bailiff is this letter, then no, of course they cannot charge you for anything else. To do so, is fraud and there is a lot of information on this in the bailiff forum.

        Besides the above, the first visit (if indeed he did visit you) is to collect money either in full or in part towards the debt - it is not, or it certainly should not be, to seize goods.
