  • Trying to get to the bottom of a problem.

    A few months ago I was a work when I received a distressed phone call from my mother. Apparently two bailiffs from Marstons had called to her home demanding money for a fixed penalty ticket I had received several months previously. Even though she told them that she was recovering from a stroke and could not read or write at the time they told her that despite it being my fine and her home she was going to be arrested if she didn't hand over her card details or step aside and let them take possession of her goods. She paid the bill by debit card (plus £2 admin fee) because allegedly one of the bailiffs was on the phone to the police.

    I came back from work as quick as I could and rang the court and they told me to do a chargeback on the card which I did.

    I have sent in a complaint to Liverpool Magistrates Court but since then I have not received any answer and whenever I ring up they try and fob me off with it not being their problem. I have also tried to call Mel Nutall who is apparently the senior bailiff at Marstons on 0161 968 3392 but he never seems to be in the office.

    I wish to continue my search for retribution but I seem to of hit a brick wall. The receipt from the bailiffs doesn't have a name to work off, only an illegible scrawl for a signature.

    What is my best course of action from here?

    You could go to HM Courts website and download Form 4 which enables you to make an official complaint against a bailiff through the courts.

      Don't I need to know the name of the bailiff before I can make a complaint?
