Hi - I received a visit from Phillips bailiff on 29th October after missing 1 payment of our £40 agreement. I had to pay the balance of £268 on my debit card. However on the same day my standing order to Phillips of £40 had also come out. I tried to get the bailiff to deduct this from balance - he called office and they had said this hadnt been received. Quite clearly it had as it stated this on my online banking. However Bailiff was having none of it. To this day i am still awaiting refund after providing bank statement and emailed them 4 times - i have been told i will have to wait up to 28 days!!!!!!!!........Please help - everytime i call i am fobbed off, cut off or not allowed to talk to Supervisor/Management!!!!..........................

If you do not know what they are for, then you should send a Subject Access Request and you can find it here Bailiff - SAR - Legal Beagles Consumer Forum Once they have provided you with this information and as Enaid said earlier, it may be possible for you to get back more than £40.

Just an update for you. I have been on the phone yet again to them this morning - one telephonist said that accordin to their system my account was credited on 1st November. However, checking online banking it shows that this isnt the case and i know for a fact it doesnt take 11 working days. I then phoned again and spoke to another man after being transferred about 4 times. He sounded like he was readin from an autocue and was so rude and arrogant it was unbelievable!. He told me that on their system it had been cancelled and it was in process of still being refunded!!!!......I really feel im not going to get this refund!

Have you read the Bailiff Guide whcih Amy posted for you in post #8? If not, you should do before you do anything else.
Don't bother phoning them unless you are very confident that you can deal with them on the phone, and know what you are talking about.
How much was the original debt, and what was it for?
You have probably been overcharged in fees, but you will not know this for definite until you send the SAR to Phillips and get the information from them. There is a templeateletter for this in the Bailiff Guide which you can adapt.
You are wasting your time speaking to them on the phone, most of the admin staff are complete muppets and wouldn't know a refund or bad practice if it jumped up and bit them on the bum. Likewise do not believe anything a bailiff tells you, they lie and cheat in order to inflate their fees and earn more money.
Read the Bailiff Guide and send the SAR. If you need any further help then post back.
Also, did they charge you a fee for paying by Debit Card?
As you have now paid the balance in full, make sure you cancel the Standing Order.Last edited by WendyB; 15th November 2010, 11:51:AM.Is no longer here

Thought i would upate you all - stil no refund or replies to numerous letters and emails. I have written a letter of complaint to the Group Court Manager at the Magistrates from whom they are employed and hopefully when they go out to tender that borough again they will be rejected and therefore sacked from Havering. I know Philips put in a tender for Kensington & Chelsea and were rejected!.....I dont hold out much hope in getting my refund unless i take them to a small claims court; which i will do as they have theorretically stolen from me.
