  • help please !!

    Hi,
If anyone has any advice it would be very much appreciated. I have 3 outstanding parking tickets that ccs enforcement are trying to recover. all tickets were giving over a three day period when the ticket machine was not working, I wrote to the council and heard nothing back. At the time of writing the bailiff has charged 357 pounds for each ticket (over 1000 pounds in total) and put them through the door at the same time. Is this correct as he has only made one visit, he will not provide a breakdown of the charges. He has also said he can force entry tonight if I don't pay
Any help would be gratefully recieved

    Hi,

I fully understand your frustration and your desire for some advice, but you already posted this:

Charges for PCN's all on one visit at 10:32

Somebody will come along and help, don't worry!

I'll try and find someone on line for you.

A few facts to put your mind at ease:
The bailiffs cannot force entry at any time over this at the moment.
If they do turn up tomorrow, DO NOT let them inside your house - not even a foot. They will use every trick and lie possible to try to gain entry - do not let them in full stop.
The bailiffs have not charged you for the tickets, they've added fees. Whether these are within legal limits or not I'll leave to someone who knows better than me.

So try to calm down, they're trrying to scare you and it's working.

If you can, scan the tickets (FPN's?) and post them on here. In the past year and a bit I've guided people through contesting over 1000 of these with over 90% success rate getting them withdrawn. Don't do bailiffs though - sorry!

Thanks alot Casper, I must admit I have started to panic a bit. I have recorded the bailiff saying he can force entry tonight and he has a van waiting.
I will have to try to find the parking tickets as it was a while ago and I didn't think I would need them.
I will look out for further posts
Thank you so much for your prompt reply !!!!

a few years ago I had the baliffs coming to me, I wrote a pre dated hand written letter handing over all my belongings to my mother for a loan of £5000.

When The balliffs arrived i let them in' they said you are being really calm about this' i said it has nothing to do with me as all the goods belong to a woman at (gave the address) .
I said remember on the way back to your depot pop in and give that woman £5000 as the stuff belongs to her'
They said can she prove it, i said she did not have to but once you take and sell that stuff you will soon find out.
          They left empty handed.
          (this was in scotland)

Thanks Pavmas, I don't know if that works in England but thanks anyway. I paid him £375 early this morning by card and asked for more time he agreed and as soon as the payment went through he said he needs the rest by tomorrow morning or he will force entry !

Did I read you right? You said you've got a recording of him saying he can forcefully enter last night and had a van wiaiting?

If you have keep it - that is VERY strong evidence, and in my opinion should be enough to have him struck off as a bailiff. I suspect it won't be, but it is certainly enough to get him into serious trouble. Try to build up this evidence trail as much as possible. I understand at the moment you want him off your back, but you can and should fight back against his illegal activities.

Out of interest - has this gone to court as that could significantly change things and he may then have the right to force entry. Could you let us know please?

Meanwhile, don't panic, it will sort one way or another and you need to be calm to deal with it. Keep recording ALL conversations etc... and make sure he confirms his name and who he is representing on them, easily done at the start of the conversation..... "Hello, is that x from x Bailiffs? You're collecting the fines outstanding from my PCN's owed to x council yes?.... Then onto the conversation. You've established his identity and what he's acting on so have solid evidence. Film footage can also be useful if he does happen to turn up ..... there's some on this site Icame across yesterday, I think it's in the how to deal with bailiffs bit or somewhere round there.

Let us know whether it has gone to court or not,

              Best wishes,

              David

                Thanks David,
Yes it's been to the traffic enforcement centre in Northampton
But I didn't think that gave them the power to force entry into a home somebody else owns.
Thanks again for your help it's very much appreciated !!!

                    Re: help please !!

Thank you very much for your advice, I will try to pay it today.
It does seem a lot of money(£750) for one visit!
When I looked on other web sites they put you in a false sense of security by recommending courses of action that don't work. Thanks so much for your level headed honest approach.
Do you know if it makes a difference if the property is my mother in laws and the bailiff has also said that my wife's possessions will also be taken. He has also refused to give me a breakdown of costs and says he has never heard of a SAR request

                      Re: help please !!

This is incorrect. Bailiffs do not have the power of entry when enforcing parking fines.

                        Hi Amy,
Thanks for looking at this thread, what do you think I should do next. It is so hard because they have you over a barrel as you can't risk getting it wrong. My gut feeling is that this bailiff is acting unfairly. Do you think the recordings will be of any use givin the things he has said.
                        Thanks again for your help
                        Brendan

                              Hi David,
I thought bailiffs only get involved once it has been to court. This is the problem the whole system should be more transparent especially involving costs. There should be penalties in place for people trying to persistently dodge fines, but in most cases on this site it seems to be one off issues that are trying to get resolved,
                              Thanks again for your help,
                              Brendan
