    Hi, i am really desperate just returned from hospital with my sick son to find a letter from marston group stating that they have a court order for non payment of fine issued on the 16/8/2010.Firstly i was aware i was in court on that day but was unable to attend as my son was very poorly i did phone the court also my local court did not deal with this and it was dealt with a court which is in another town far away from me.
    secondly i did not know how much i had been fined i have never recieved any letters from the court and only the letter i got from marston today.
    Basically they have given me 7 days to pay the full amount i am on benefits and care for my son 24 hrs a day i am willing to pay the fine but cannot afford to pay it all in full and willing to pay in installments but have heard marstons will not accept this.Please can someone advise me i am really desperate i have no family around to help, please?

    Were you not sent a copy of the judgment?

    Is there any particular reason why as you knew you should have been at court, you didn't bother to find out the outcome of the case?

      You need to understand that for certain types of fines for example parking fines, speeding fines and TV licence fines, bailiffs do have the power to break into your home to take your goods even if they have not been into your home before. You must, therefore, treat a Magistrates Court fine as a priority debt because you could be sent to prison if you default on payments and, although very rare, this does happen.

      For this reason it is no longer safe to try to avoid bailiffs coming into your home by refusing to let them in for the collection of the fines mentioned above.

      They whys and wherefores do not matter in this instance.

      If you did not attend the hearing, the court can issue a warrant without bail and this means that you can be arrested and brought back before the court.

      You must contact your court immediately.
