Help, Distress Warrant from Marston has been implemented. Clamped my vehicle

  • Help, Distress Warrant from Marston has been implemented. Clamped my vehicle

    Hi all, I have a distress warrant issued on the 4/10/10 by Gloucester magistrates court. This was for driving with out insurance back in 03/09. I was unable to pay at the time and as a result had to return to the warrant officer after a warrant for my arrest was issued in 01/10., for the sum of £300.

    I agreed with the officer to pay £50 on the spot and then £50 a month from the 01/03/10, which he stated was good. The reason for the delay is that i am a self employed gardener and i tend not to be able to work during the winter periods.

    I paid my first installment, late i know, mid April, and paid a further £100 following that. The reason for late payment is quite simple, a very hard winter and work not really coming in till April.

    I received a cheque from the HMCS for the £150 i had paid towards the fine on the 28/05/10. That in my opinion makes up all payments as arranged, covering Mar/Apr?may, however i did not look at the date he put on the form i signed which has now come to light states the 01/02/10 as first payment.

    I have been informed by the court after submitting a Statutory Decleration that it is not accepted due to the fact i had signed the payment plan at the court and that they do not inform you of court hearings regarding Distress Warrants. ??

    The first i heard from Marston was on the 06/09/10 when, despite being in the house, a distress warrant was posted through my letter box by the baliffs. He did not ring or knock the door, i know this because my dogs would, as usual gone potty at the sound!

    The warrant stated he had seized my vehicle via a clamp. Which he surley had.

    I tried conversing with him to make an offer of payment but he would not even allow me to talk, but spoke over me shouting the debt needed paying, this is in despite of the fact the vehicle is a work only vehicle containing my tools!

    This has now prevented me from working for nearly four weeks! If i was able to work i could of paid the debt now at £525!

    Thgis is despite the fact that i am now only able to work 2 - 3 hours a day due to as of yet undiagnosed medical condition which has left me without sensation down the whole of my right hand side, for which i was hospitalised on the 06/08/10 and had an MRI Scan on the 21/09/10, awaiting results.

    What do i do? Help PLEASE!
