    HI all

    Been reading all the posts and see that many people have had trouble with the bailiffs and councils before, we have had a dispute going with Liverpool council now for quite a few months, they are trying to claim council tax payment for 6mths in 2003, however we have disputed this as we moved to a different address within the same council and never been told that we owed anything and in fact when we moved form th original address in question we phoned to say council tax had been paid for that month but assured that this would go onto next propertys bill, unfortunately at that time we paid by payment card at the post office or in the council offices and we did not keep the receipts from 7yrs ago.
    This yr april time we recieved a letter form the council saying about unpaid council tax, we disputed this and they said that they were looking into it and it would be sent to bailiffs if not paid, then a few months later in july of this yr my partner had another letter stating that we owed a different amount by the council, phoned again and again fobbed off, a few days later we also recieved a letter wanting to know or statement of outgoing incoming etc, we took all the stuff to citizens advice who advised us to write to council requesting all correspondense over the past 7yrs as they stated they had been trying to find us for yrs when we actually lived in another address in liverpool for 6mths after the address in question and where paying council tax there!!
    However no repsonse has been received from liverpool council and today we came home to find a letter thro the door from rosendales stating we owe 486 to liverpool council plus charges!! And if we did not contact them within 24hrs to make arrangements they would take legal action to regain the costs and take goods, it also stated we could pay 60 today and make arrangements for monthly installments. SO contacted the council who said they put the emails requesting details in the closed case address!!! and will put a 5 day hold on bailifs, we then contacted the bailiff to tell them of this, they said no-one will call for a few days however I dont think i trust a word they would say from what I have read. So all doors windows etc locked and will not be answered if in for a while.

    Any advise from anyone who has any experience would be grateful!!

    Am not impressed as we are 110% sure this was paid at the time of lvining in the address but we have no proof, think we will see a solicitor tomorrow. We have a 2.5yr old at home and will not be intimidated by these people, I do not however want them calling at the door, nor do I not want to be able to play in the garden with my daughter incase they should come round!!

    So to clarify then, your council are saying your owe six months of council tax payments and you are certain you have previously paid this?

    I know you have requested your information as advised by the CAB, but was this a formal Subject Access Request together with the statutory maximum fee of £10?

    You also need to stop talking to the bailiffs and deal only with the council.

      Hi there

      Thanks for your response, yeah the council are saying that we owe 6mths council tax, the original letter stated we owed 4yrs council tax and we only lived at the property for 6mths, follwoing giving them all the detaisl of addresses over these 4yrs they amended the dates to the same as we had told them. Again my partner has spoken to them today and they said they had put a 24day stop on the bailiffs to investigate the matter further, however I have just checked the emails and they emailed us literally 20mins after this conversation to say that they had looked at the accounts and we owed said amount and gave payment dates for next property we lived in in liverpool and 2 of the payments where made after we moved out one being 4mths after we moved out, which is crazy!! And the email states that the account is with rossendales and that they do not want us to deal with them anymore but with rossendales, which we have no intention of doing. My partner has an appoint with a solicitor on thurs, this is crazy, our neighbour just told us someone was snooping around the house on friday!!

      Haved sent the 10 or asked for it that way but will be now!!

        Yes, I think a formal SAR is the way to go for the minute.

          Hi thanks for all your advice
          I did contact the council and bailiffs about the issue, and eventually after a long letter to the council they have stated that they will take the alleged debt back from the bailiffs and accept the payments that we have offered, however in the time that they had put a hold on the bailiffs, they made a return visit and did a walking possessions order on what they could see in the garden including the shed, we he has stated on the form is open when it has a padlock on, I am going to make a complaint about the visit after a hold was put on by the council and also for lying on the order about open shed and when my partner phoned him to explain about hold he said he had never spoke to her and shouted down the phone and hung up, how rude!! Anyhow am pleased the council has take it back even tho am really annoyed we are having to pay it again!! Can the bailiffs still chase us for the first visit fee now??
