  • Bailiff Removal letter

    Hi,
    I have already read the Bailiff Guide but am unsure on a couple of points.
    If I let a bailiff in peacefully to deliver a Removal letter does this mean he can break in another time. he only gave us the letter and did not make any lists of our goods or anything for removal.
    does he have to be given peaceful entry to make the list or not?
    once hes got the list of goods do we then get given the option to pay and keep up wiyh payments or they take the goods.
    we have offered £30.00 a month which is all we can afford but he said that was no good and said pay £287.00 in a few days or he would be back to makw list and take the goods.
    we have already had a bailiff about this a few months back and we offered the same £30.00 a month n he said he would let us know if it was acceptable and if so send a means form for us to fill in. we heard nothing until today from the bailiff mentioned above from same company - we said about previous bailiff and the offer we made and about waitong to hear and he said that 1st bailiff sent means form to us but we didnt reply - This was a lie! we had no form at all!!
    Please help as we just want to get it sorted and we are trying to offer payment. we are so scared that they will come and break in whilst our 12 year old son sis in - It would scare him and upset him so much.

    Yes, unfortunately it does. Although you should bear in mind that this is very, very rare.

    What is the background to you allowing him entry and did you grant entry for the same liability order he is attempting to collect on?

    Were you paying anything while you were waiting to hear from the bailiffs?

      I had a visit from JBW Bailiffs....I have had experience of them in the past..wherein a couple of parking tickets ended up in me having to pay JBW over £2,000.00....this time its so clear in my mind....so I will start at the beginning...

      I received a parking ticket from Bexley Council. I had a alid ticket but apparently I was not parked properly. However I did notice that the lines on the parking bay were very faded. I received a parking ticket and contested it to Bexley Council. I received a reply to say the parking ticket still stood. It was the run up to Christmas and it seemed to get forgotten about. Then 3 weeks ago, on the Monday, I had a letter put through my door from JBW Group saying I had to pay £316.00 and if I didnt pay it that night it would go up to £530.00. I tried o ring JBW that evening and got an automated recorded service, only asking for payment. The next morning I wrote to JBW and Bexley Council asking for copy correspondence as I hadnt received any in the past. I didnt receive a reply to my letters from JBW or Bexley Council.

      On the Friday morning at about 5.00am I heard voices outside my house. As my husband was leaving for work 2 men, Bailiffs, approached him and said they were going to remove my car unless we paid the £530.00. I told them I had written to JBW and Bexley Council and that the only response I got was a letter from JBW with a photograph of my car. After a lengthy argument wherein my husband said he needed the car to get to work they said it wasnt a work vehicle. He said if I cant take the car and go to work he would lose his job, we would lose our house. They said we still had to pay the fine and if they removed the car it would be the fine plus £25.00 per day. In the end he walked out of the house and said "take the Car". They said could we empty the posessions. My husband refused and he walked off up the road. They then shouted out to him to come back and if we could raise the money they would give us a week to pay. I said couldnt we pay by installments and they said no. I then agreed to pay the fine 2 weeks later. I wrote to JBW and Bexley Council once again....no reply from either JBW or Bexley Council

      So today I am £530.00 short of my mortgage....

      I am now in the process of contacting my local MP as this is absolutely disgusting. No wonder people are unable to pay heating bills, or food for that matter and finally losing their homes because of this.

        Hi.

        Just a thought. Did you not think of calling the police to remove these people, calling at that hour of the morning? The rules are very clear about when they can call I believe.

          If I'm not mistaken a parking ticket is unlike council or revenue taxes or court fine not something that can be collected by impounding or clamping your car without a warrant of execution provided by the court AFTER a CCJ has already been obtained.

            my partner let the bailiff in, after him talking to my son whose 12. yeas it was for the same liability order from earlier in the year.
            To answer the second question we were not paying in the meantime.
            we have since rang the council and offered to pay them direct at 30.00 a month but they say it cant be taken from the bailiffs hands and we need to contact them direct. we have not contacted the bailiffs again.

              Well Janey, this will amaze you, but the council are being a tad economical with the truth. They are perfectly able to recall the debt, they just choose not to.

              If I were you, I would write to the council. Tell them your circumstances and provide an income and expenditure sheet to show them you are strugging. They have a duty to help people in difficulty, which you clearly are, you just have to make them do it, but in the meantime you must make some payments.

                We will do as you say. We could do with knowing just exactly where we stand with regards to the bailiffs coming in without proof of them ever been given peaceful entry.

                  Although I am surprised he didn't ask you to sign a walking possession, it is not unheard of. What did the removal notice say? Was it merely a generic letter?

                  Even though you haven't signed anything, the bailiff has nevertheless been granted peaceful entry, but as I said in my first post, it is extremely rare for a bailiff to break in to a property so try not to worry, which I know is easier said than done.

                    Janey, when you speak to the council, tell them that you know that they can call the debt back from the Bailiffs.
                    Use this tact, if you pay the Bailliffs they will take some of the money in their charges, if they (the council) take the debt back they will recive 100% of the monies.
                    Worked for me.
