  • bailiff fees ????

    hi there this is my first post , so hi to all .
    i had a visit from the bailiffs about a month ago for unpaid council tax , we were out and the bailiff left a letter with a number to ring him which we did and he was due back the following week to set up a payment plan .
    i researched the topic on this and other sites and realised not to let them in or sign any thing , he came the 2nd time we were out again but the letter he left was for a lot more money than we owed the council .i wrote a letter to the bailiff firm ross and roberts ltd saying that i was paying the council direct and would not be dealing with them and that i thought their charges were to high as nothing had been levied on the most they could charge was £42.50 we have had a 3rd visit i was home told the guy to go away , he said he needed some details from us i just slammed door in his face.he left another letter with a lot lower amount on so i believe they had recived my letter and taken the charges off .
    i have since paid the entire amount oustanding to the council direct so my debt to them is now clear .
    will the bailiffs still persue me for there charges of £42.50 , can they levy my vehicle for the charges really dont want to give them a penny ,
    not sure how this works , the guy from the council said he would contact the bailiff firm to let them know the debt is clear .

    Do you still have the paperwork from the second visit he made? If you do, I would say this is more than enough to have the council cancel the fees as the fees added are clearly fraudulent.

    Just in case the bailiffs attempt to levy on your car, be careful where you park it until you have formal notice from the council that the fees are cancelled.

      thanks for the reply .
      yeah i have both letters .
      the original amount i owed the council was £440. the 1st visit letter had a figure of £679 but during the time between the 1st and 2nd visits we had paid off £80 , the 2nd visit letter had a figure of £569 .
      i have never let them in and they had not levied on my car , when i wrote to the bailiff company to tell them that i thought there charges were to high i had a letter back saying they had only put the £42.50 on .
      what should i do should i contact the council again .
      can the bailiff still legally enter my home peacably , even now that i have paid the debt in full to the council ..

        No, the bailiff cannot enter your home at all and yes, I would write to the council and enclose copies of the letters put through your door showing their inflated fees.

        Have a search around the bailiff forum, there is a lot of information on fraudulent bailiff fees such as the following:

        The Minister of State, Home Office (Baroness Scotland of Asthal): A bailiff or any other person who dishonestly charges for work that has not been done will be committing an offence under the Fraud Act 2006. Section 1 of the 2006 Act contains the new general offence of fraud.

          i will be contacting council 1st thing tuesday regarding this .
          thanks again , you have a wonderfull site that really helps people when faced with these problems .
          i was in panick mode until i found this site , which i found some very valuable information and i fear i would be in a very different situation if were not for this site
