      YOu are well within your rights to go to the court on the date set out on the council tax summons and put your case forward.

      However, for this summons to have reached you, a demand and a reminder will have been sent out previously, if you did not receive either of these it's up to you to prove you didn't unfortunately.

      Have you changed address recently? If so, the council may have sent the bill to an old address, you'd have to prove this was the case though and if proved, the council should withdraw the summons and costs.

      Best thing to do would be to call the council and question this with them.

      I must warn you though, a lot of people use 'I didn't receive the bill, reminder, 2nd reminder, final notice, summons letters' as an excuse for not responding sooner. It's only when the bailiffs come a knocking that the alarm bells ring! So, I wouldn't rely solely on 'I didn't receive the bill' as your evidence.
