    Hello,

    Charge is for Parking Fine from another Council

    My Brother has received a notification from JBW Group asking for immediate payment, and advising that they have obtained an update from DVLA which entitles them to remove or seize his vehicle (which is Hire Purchase) My brother has hit financial difficulties but i can pay off in installments for him, on his behalf. ie charge is £396.66, I can pay £150 and installments after.

    Please can you advise if this is possible at this stage as I am willing to pay it for him but obviously not in one go. Any advise would be welcomed.

    Please can you tell me if it would be advisable to contact JBW via email to enable proof of contact rather than telephone. I have also read some horror stories where people have agreed with JBW Group and they still have problems.

    Did your brother know anything about the pcn. I.e did he appeal and recieve no reply or did he never recieve anything about it or did he move address etc ?
    If you have any sort of problems with bailiffs. I can help you as i am a self proclaimed specialist at dealing with them. I am hopefully going to start a degree (law) from october.       A Bailiff has no requirement to accept a payment arrangement, but it is rare that a REASONABLE offer of payment by arrangement is refused, and if it is, this is usually because the council have advised that the debt must be cleared in full

        Have you contacted the relevant council direct to try and agree a payment arrangement with them? Also SAR the bailiffs, and get a list of exactly how the debt is made up, what charges they have added etc.

          If you contact the council and set up an arrangement with them the bailiffs will still call at your address as their fees are legally enforceable, and you will continue to be chased for the sum outstanding to the bailiff company, they have the right to remove goods to cover the fees too. Just by getting the council to recall the debt will not stop Bailiff visits

            Well thats where you're wrong, have a look at my thread. I have come to an arrangement with the council, still have to pay it to the bailiffs but they have removed all charges, because they did not follow the councils instructions regarding a payment arrangement and admitted they had not visited when they said they had. And I have it in writing from both the council and the bailiffs.

            Each case is different so please don't generalise.

            As for a reasonable amount, what is reasonable is a matter of opinion and depends on individual circumstances.

              I think there is some confusion on this thread with the differences between council tax bailiffs and parking fine bailiffs.

              The best part of £400 is rather a lot of money for one parking fine, so you should send a Subject Access Request Bailiff - SAR - Legal Beagles to ascertain what fees have been applied because they are only legally enforceable if they are legally applied for genuine work carried out.
