  • Can Nothing Be Done?

    From the beginning of this year 2009 the parking attendants in my home town hit the streets in droves since they began they have accumulated over 4 million pounds in revenue. This is from a town with just 50'000 population at least every car in the borough has been hit and mine 10x. OK i should have paid them when i got them but i thought I'd try to be a one man army! to no avail.
    I know owe equita for 10 fines and have had at least 50 letters 1000 phone calls and warrants of execution it was only when a bailiff turned up on my door that i realised this wasn't going away!
    I got my act together and started to try to pay, i paid off over £700 in three months and continued to receive letters, final demands, phone calls until i got through to someone who told me that the other fines would continue to grow because they were not being dealt with quick enough? surely the fact I'm making regular payments means that the account should stop? I was horrified to fined out that i had only paid off 2!! £700 for 2 at this rate I'm going to owe them close to £4000. each time I'm close to paying for another one they just add more charges, can they do this?
    I'm at my Witt's end i will never be able to get on top of this if they continue to add costs, is there anything that can be done to group these all together and have a full and final payment that i can then pay off at a reasonable rate, rather than the paying off what they wont when they wont to as to get more and more cash from me!!
    The council has now seen there is a problem £4 million better for it and are presenting parking permits all be it to late for me. I have tried to phone and just get wound up by some obnoxious Wozzeck on the end and i even wrote a letter to which as yet there is no reply. Does anyone have some legal spiel i can spout down the phone to show them I'm not having this or I'm i officially snookered?

    Rightyo then - you need to have a read here Bailiff Guide - Legal Beagles and then send the bailiffs a Subject Access Request (also in the link). I would wager that they have added a lot of fees to which they are not entitled and now you need to find out exactly how much and what they have added these fees for.

    Have you previously requested photographic evidence of your alleged transgressions? If not, you need to do this in the same letter.

      The letter that i sent was a list of references to each fine and requested a full amount due incorporating all fines, as i say this hasn't arrived yet. Do i need each fine broken down to find out what and how much i am being fined? My concern is that whilst this is going on I'm incurring more fines or is there a law that states whilst you are trying to astatine something from them the accounts should stop? The laws with these places seems so fickle and i really have no understanding of what there laws are, although your information is very helpful it dose seem as though it varies a lot is there nothing structured or ruling about these beasts?

        The reason for sending a Subject Access Request is to ascertain how much they have added in fees, not for finding out the amount of the fine as presumably, you already know this.

        Bailiffs only earn their money from adding fees and an awful lot of their fees are added when they seemingly pluck a figure from thin air and add it to an account. As you have already stated you are not getting anywhere at your current rate of repayment because of these fees and are likely to have paid in the region of £4k when the final fine is paid.

        So is it not better to try and find out what they have added these fees for and to try and have the nefarious ones removed?
