i have found an article on national standards for enforcement agents on vulnerable situations. would my girlfriend come under this as she is unemployed in reciept of state benefit, has two young children and is currently on medication for postnatal depression? i have found a letter template which i am supposed to give to the enforcement officer or post to their office explaining the situation and apparently are supposed to acknowledge this. also i have found out that she was convicted of non payment of fines on 12th july this year but receiced no letters to inform her of this so will get a statutory declaration done tomorrow for this but the enforcement officer is coming back in the morning so would this be too late. the court wont give her a means hearing because its in the hands of the bailiff but have been told she can write to the court manager to explain circumstances and they can review this. is this true?

yes i did. thats why i am getting a statutory declaration done tomorrow but wasnt sure if it would be to late as the enforcement officer will be here before we have chance to get the declaration form signed. who do we give the form to? the bailiff? what does he have to do when he recieves it?

i have been to cab today and they spoke to the bailiff on my behalf and he said he will not return this to court. i have been to the solicitors to get a statutory declaration signed to say what items in the house are mine and cant be touched. if he turns up tomorrow and there is nothing of value in the house to take and also we tell him we cant find the money up front, will this get returned to court? if not what will happen. thanks for your replys

I am sorry that I have only just noticed this question. From reading your post it would appear that a summons had been sent to a previous address. Because of this you are legally able to file a Statutory Declaration to SET ASIDE the conviction.

The effect of this is that the fine will be CANCELLED and with it all bailiff charges.

The court can then reissue a further summons at your present address and your partner may then either plead guilty by letter or attend court to contest the charge.

If she either pleads guilty or is found guilty, she can then complete a means statement to repay the fine at affordable monthly payments.

The type of Statutory Declaration that it appears that you have completed is merely to confirm ownership of goods. This is NOT what you need !!

The downside however is this: You have just 21 DAYS from that date that you were made aware of the fine to file the Statutory Declaration. I calculate that you MUST file this no later than tomorrow.
