I am on the receiving end of a fine following a parking ticket I never received. I have written to and phoned the council on several occassions and explained this, but now the matter has been handed over to the bailiffs.
In order to stop this escalating further, I have paid the initial fine plus court costs and bailiff admin costs, which I fully intend to claim this back.
However the bailiff company is trying to charge me £400 for two bailiff visits. I work from home and was in on both days they claimed the visited.
Do they bailiffs legally have to prove they visited my home? Or can the just claim the money from me?
I have since been handed a letter from the bailiff that was put through my neighbour's door. However the notice of attendance is incorrectly addressed. It has my surname but the wrong first name.
Does a) wrong delivery and b) wrongly addressed notice mean that this Notice Of Attendance is invalid? Where do I stand legally with proving that the bailiff did not attend and did not serve notice correctly?
I cannot afford to pay this.
