  • Marstons Bailiffs and a right old mess

    Hi - I really need some advice. Not so much as the money, but how to get back at the bailiff who has caused me such problems.

    First off, through moving addresses I didn't receive court papers for a wrap on the knuckles over car tax from the DVLA. Fair cop, but actually there were mitigating circumstances, that I wanted to air in court. So, silly me thought it had gone away when I didnt hear anything.

    So, a couple of years later, a Marstons bailiff appears, out of the blue, demanding a large wadge of money. I didnt let him in, and declared that I hadnt a clue what he was on about. He went away, and I eventually pieced it all together, having contacted the court. They told me the procedure, which I followed, but then a couple of weeks later guess who turned up on my door - except that I wanst there - my wife was. She naturally became distressed, and of course chewed my head off - but importantly - gaveme an ultimatum about bailiffs turning up at our door. I managed to get him to leave again (over the phone), having badgered the court.

    I wrote to the court, and they gave me permission to re-open the case as I hadn't had the opportunity the first time. Unfortunately I couldnt make the court date due to car problems, but had advised the court, and they gave me a new date.

    I was away on holiday with my family when I get a call at 8.13 from the bailiff, saying he was on my doorstep (I was asleep at the time- hey I was on holiday! so he left a message) . A short while later he called again and left a further message, saying that he would be returning with a locksmith.

    Soon after, I called him, and told him that the court had reopened the case, and he told me that that was nonsense, and that I hadnt contacted the court (funny that - thats what he said on his second visit). I then rang the court, got the details, and texted him them back. He then texted me back to say that the court had confirmed it.

    Thing is, he also posted a card through the letter box with the amount owing, and that I had 7 days to pay. The next day, my mother in law entered the house to check all was well, and found this note. This naturally sent her spinning, and of course she rang my wife...

    So, my family's annual holiday has been completely clouded over, and I'm honestly not looking forward to going home.

    My question is - can I take any legal action over his methods -
    a: by threatening locksmiths (I have the phone call saved)
    b: by turning up when it was back in the hands of the court
    c: by revealing sensitive information via an easily read card to people that I would have preferred not to have seen it

    This is very important to me, bearing in mind his actions may have cost me so much more than a court fine...

    In the first instance you need to complain to the company this bailiff is employed by.

    In the meantime, have you checked if the bailiff is certificated - you can do that here Certificated Bailiff Register - Legal Beagles

    Have a read of the Bailiff Guide and you will find details of how to make an official complaint should the need arise and should you wish to do so.

      Thanks for your help. He's not on the certificated bailiffs list - but looking at the paperwork he's listed as an enforcement officer. Is that different?
