  • Rossendales Bailiff Removal Letter Please Advise

    Hi,

I urgently need some advice in regards to a letter received yesterday through the letterbox. My husband who was asleep at the time (he works nights) managed to speak to the man through the bedroom window has he was leaving.
The man just said he'd posted a letter in regards to council tax, and walked away when my husband replied i was at work and was the one dealing with it.

The letter is from Rossendales with BALIFF REMOVAL at the top followed by MAGISTRATES LIABILITY ORDER / DISTRESS WARRANT and a ticked unpaid council tax box then PAYMENT IN FULL_ 24 HOURS.
It goes on to say ' I have attended today with the intentionof removing your goods and chattels as are necessary to discharge the above debt and any additional ENFORCEMENT COSTS incurred. It then states that no further arrangements are acceptable and payment is now required in full by CLEAR FUNDS ONLY, and he will re-attend at our address at his convenience and REMOVE goods even in our absense, and to avoid this action contact him on a mobile number to arrange prompt payment of the debt.

There are no figures on the letter, no mention of the amount to be paid, and apart from a red counil tax reminder last week (which I was in the process of dealing with) we haven't received or heard anything else in regards to any council tax debts. The client ref at the top is also different to the council tax reference on our red council form (the size is same but different digits). I really am unsure where to go from here and myself and my husband are now petrified someone is going to come back and force entry whilst our three young children are present. Please advice and thankyouin advance

    Worried Mum

    Welcome to Legal Beagles Helen.

I'm afraid I don't know enough about Bailiffs to help you tonight, but someone will be along tomorrow to advise you.

While you're waiting for advice, you could read the following thread which will give you an idea of what Bailiffs can and cannot do.

The link posted by CJ is a link to the bailiff guide - have you read that?

If you only have one reminder letter from the council, then you are unlikely to have been given a Liability Order against you for non payment of council tax.

You need to speak to the council and find out what is going on and if you read the bailiff guide posted above - you will see what the bailiff can and cannot do.
