  • Really need some help PLEASE!!

    Hi,

    I have read a couple of posts on Marstons on the forum already, and i must admit i am shocked at the lengths that this company will go to in order to get money!

    So let me get straight to the point,

    I live in the Cheshire region of england with my partner and 3 children, the eldest being 7 and youngest being 21 months.
    Aprox 2 and a half years ago we got into serious struggles with money and struggled to come up with the money to pay our council tax. So, at that point the debt was sent to the magistrate courts and we were summons for a hearing for means or something like that, unfortunately we couldnt attend due to my partners health issues and got fined about £250 for failing to provide details to the courts.

    so between late 06 and late 08 we have had a bailiff appear at our house about this once or twice and it even went as far as a police officer attending our home to arrest my partner as the tenancy is in her name the council tax bill is aswell... they couldnt arrest her as she wasnt home so the officer who i must admit was extremely helpful and understanding took some details from me about national insurance what benefits we're in receipt of and went on his way,

    about 3 weeks later we got a HMCs prepayment card through the post, this was in late january this year. Bonus! we thought, after all this time they are going to accept a payment of £5 per week which we are able to meet without hurting our finances.

    unfortunately late april my partner lost her purse with not just THAT HMCs card in. So i tried to contact the courts via telephone to get a new one, couldnt get thru, consistently engaged at the dept i needed to speak to. So i sent a letter, thinking that the court we were supposed to appear to is over 20 miles away and that a local court wouldnt be able to deal with our request,

    The last payment on the card was made in april of this year and up until that point we were coping fine and were making grounds on paying it back, i think the problem we had though is as we get paid fortnightly we couldnt pay the £5 per week and instead paid £10 per fortnight instead which left us in arrears apparently so upon losing the card and already having arrears and the court not responding to my letter in request, we received a letter stating that the debt had been sent to marstons in late march and that any payments made to the card wouldnt be accepted on the courts behalf but they would pass them on to marstons.

    2 payments of £10 were passed on because we received a letter from marstons saying they received it and that payment must be received in full.

    Anyway, im now at a point that yesterday a bailiff by the name of "mr brooks" slams on my door like someone on fire and desperately seeking any means of being "put out" so i quickly jump up and answer the door to him.

    Now bare in mind that this debt isnt in my name its in my partners name because as previously stated the house is in her name. So i proceed to ask him whats up and he says he is here to execute a warrant as authorised to him by the magistrates court and the fine and his charges are now £370, i already paid a fair chunk off the original fine so i was shocked to see it being so high again. I explained the situation that we requested a new payment card and got nothing, but, about 2 weeks ago my partner went into the council and requested a payment card from them to pay any arrears owing and the fine, and we were assured by the council that no debt collectors or bailiffs will make an appearance at our home and i was quite shocked that he was here, turns out that was a mistake because after the bailiff left happy that i wasnt trying to "blag him" and understood that i did make some payments already he said that my best bet is to contact the court offices to find out what when on, he gave me a number and a reference number and said that at this stage he doubts there is much the courts can do but its worth a shot because they could call back the warrant and get this whole issue fixed. Fair enough i thought.

    So we get to the point of when the bailiff has gone.

    I contact the council who say that the fine isnt imposed by them that its a court fine and that the person who dealt with my partner 2 weeks ago should have explained this to her but didnt.

    so i then contact the courts who tell me that mr brooks shouldnt have advised me to contact them and that they would never recall the warrant and mr brooks is incorrect for advising me of this and she wanted his name so she could contact marstons and tell them off about it.

    then she went on to say that marstons dont accept payment plans or its highly unlikely they will, unless i am probably willing to pay it off within a 3 week period or so... so id have to pay in full!

    i explained we're on benefits my partners health has been a serious problem for her for several years and i cannot work as i care for her and need to be here for my children 1 of which isnt in school and is only a toddler, i explained the situation about attempting what forms of contact i made given that the court house is 20 miles plus away and i cant just get up and get there to speak to someone in person. To which her reply was i could have gone to my local court house anyway and even made payments over the counter and even request a new payment card with them, so for future reference to anyone with that issue just because your court hearing was held many miles away doesnt mean that your local one cant sort any issues out for you.

    Anyway, things started to get a little confusing for me on the phone with this lady from the courts. I asked her from a neutral persons point of view what are my options, i understand she worked for the court but because of our financial situation and the fact we had already made payments previously what can be done so that we dont end up going into debt or struggling massively financially.

    2 options were then laid before me:

    1, Contact some family or friends and get them to pay the fine and pay them back, unfortunatly this is a no go, current financial climate and all that...

    2, Only the bailiffs can return the warrant, the court will not request it back. i asked further into this option, apparently the bailiffs have a period of time to enforce the warrant, upon which if they cannot execute the warrant then either the time period has lapsed and it has been recalled to the courts for further appearance, or the bailiffs themselves can return it early, however i was told the latter is very unlikely because, IF the bailiff returns the warrant they are unlikely to get paid, when they return a warrant they have to show reasons as to why they couldnt get the money where as, if the court requests the warrant back then the bailiffs will be paid because the time period of when they had the warrant means they have exhausted all routes to get the money.

    Hang on a sec? bailiffs can send the warrant back? court CAN request it back? but i was told by the bailiff its down to the court and the court its down to the bailiff!! something isnt right here im thinking. So what do i do??!

    Ive contacted a loan company i looked up online and i could get a short term loan from them for £400 and repay it back within 1 year at just about £40 per month, which to be honest is a reasonably interest rate but it will be a bit to sort out as they want an £30 administration fee, which can be paid 2 ways, either by debit card, which i dont have, or by postal order which means it takes time to get the money into my account, altho the loan company did say i could get a friend to pay the fee on their debit card and have the money in 5 working days if we paid it by debit card. After reading up on what not to do on these things its my final hope of getting this off our backs once and for all but have a just 1 fear.

    If i got this loan and i asked a friend to pay the fee and i gave him the cash what the hell do i do if the bailiff reapears before i get the money? knowing what marstons are like he will likely think im blagging him and then get the locksmiths in and the police in to execute the warrant wont he? or is that just an idle threat? Can they actually get a locksmith and involve the police??

    Where do i go from here? do i get the loan or is there another way that wouldnt hurt my finances so much, especially considering the length of time the fine has been imposed? please please help im sat in my living room now as i type this with my front window curtain closed the door locked my back window in my living room curtain closed with the house in almost complete silence apart from the washing machine worried that this guy is gonna be able to get in and start taking our things.

    I take it then that at the time you received this summons to your means hearing, you already had a liability order against you for the non payment of your council tax?

      Yes amy we did, it was made by rossendales and they didnt get a single penny off us, it was promptly returned to the council who made an attatchment to our benefits.

      Also i forgot to mention in my OP that when i was speaking to the lady at the courts i said that should the warrant be returned or requested back then we wish for an attatchment to our benefits be made to recover the fine. the lady took the relevant details and made notes to the effect of my request.

        well, if they made an attachment to your benefits, how come its got to this stage? Have they been taking the attachment? Or is this for a second debt of Council tax? i believe you can have 2 attachments in place at any one time.

          its not the arrears thats the issue its the court fine for failing to provide information that is unpaid. the arrears is sorted but the court fine is outstanding, i spoken to the council about it and they said everything to do with the arrears is in order and that the bailiff will have appeared for the purpose of getting the court fine paid for failing to provide the information, so what do i do now?

            You must treat a Magistrates Court fine as a priority debt because you could be sent to prison if you default on payments and, although very rare, this does happen.

            Council tax debts are known as jointly and severally liable debts and that can mean a husband and wife, co-habitors or two or more people living together at the same property will be responsible for the payment of the council tax whether or not their name appears on the council tax bill.

            Have you seen the warrant? The warrant is only vaid for 180 days, when was it issued?

              no he didnt actually show me a warrant but upon speaking to the court offices they confirmed that marstons were in possession of a distress warrant, my main priority is finding a way to get this out of the hands of marstons and back to the courts to do an attatchment of benefits if at this late stage it is at all possible, if not then i guess im down to the loan option, so i dont know where to go from here, how do i get it back into the courts hands and then they can go ahead and make the attatchments to benefits? oh and the warrant i believe was issued last week of march or second to last week of march 09,

                It sounds to me as if you need to speak with this bailiff and arrange to pay him and see if he's agreeable.

                  hmm, so if he doesnt agree what do i do? i mean i can get the money by next friday, what if he says he will be at my home before then to remove goods if i dont have the money before i can get it?

                  i mean i know my OP is long but to sumarise

                  1, Can Marston bailiffs actually involve the police and a locksmith to gain entry to my house even when im in it or is that an idle threat?

                  2, after speaking with the courts they stated that after a period of time the warrant will go back to them and they have taken details to setup an attatchment to benefits, do i wait it out?

                  3, In your opinion is it even possible that i can avoid the bailiffs sooner than the 180 days? Is it possible that if i apply to the court for a means hearing myself and they will retract the warrant and i can get the attatchment to benefits sooner?

                  I really am very confused and worried about this, i have alot to deal with in my house with 3 children and a partner that i take care of, the added stress from this is not doing me any favours and i just want it resolved as quickly as possible without adding further stress with finances, the attatchment is the most affordable option, and although a loan is an option its a costly one, it doubles the outgoings per month from £20 if it were an attatment to benefits to £40 on a loan repayment per month, and though it may not seem like much to some it is to us, the budget is very tight already.

                    Yes they can and no it's not, although it is rare.

                    The period of time is 180 days so they are well within that timeframe. By your calculations it would give you another 3 months or so of being a virtual prisoner in your own home and hiding from all callers to your property.

                    It's unlikely I would think and see above.

                    Anything is worth a try and you will not find out unless you try. If this fails you will have to speak with the bailiff.

                      I think i made a break through!

                      So i rang the enforcement offices, found out the following things and double checked it against my letters

                      1: the original fine ammount was £210
                      2: when the fine went into default on the 31 march the owing ammount was £165
                      3: on 31 march i was unaware that it had gone into default and made 2 further payments of £10 bringing the total owed on the fine to £145.
                      4: marston sent letters confirming the receipt of said £20 but still asking for full payments and the figure is NOT on the letters for what is the full payment, just to ring and pay. Only these 2 letters have been sent stating they have received payment nothing else( can that be considered as a notice at all??)
                      5: Mr Brooks who came to my house yesterday issued me with a red letter stating Final Notice for the sum ammount of £370!! this is by far in excess of their standard call out fee and 2 letters administration charges, even if those 2 letters can be classed as administration? more like confirmation to me!
                      6: I CAN apply to the courts for a means hearing, just because there was a warrant for no bail on doesnt mean it is a suspended sentence so therefore we can get the ball rolling on having an attatchment to benefits which tbh is fantastic news considering the ammounts owed discrepancy.

                      Can someone clarify what the standard charges are for these guys to appear at my house and what if any their charges are for sending just 2 letters of what appears to be nothing more than confirmation to receiving £20?

                      Btw, i really do appreciate all your help on this, if you can point me in the direction of where the thanks button is ill click away!

                        Sounds like you're making good headway with sorting this out, well done.

                        Marston are permitted to charge you £50 for administration/first letter, followed by £100 attendance fee.

                        Their fees are capped at £200. Maybe you should consider sending the bailiff a Subject Access Request.

                          OK not good news it seems.

                          Magistrates court are willing to proceed with the attatchment to benefits, i went today and spoke to a judges clerk who clarified that first, then she contacted the enforcement officers, who said that unless the bailiff returns the warrant to them they arent gonna do nothing about it, the reason being is because if the enforcement officers pull the warrant from the bailiff then the enforcement officers are apparently liable for the bailiff fees, C/D? so they said contact the bailiff see if I can get him to return it.

                          So i spoke to the dreaded bailiff,,, i really didnt want to tbh, but, i was suprised at his reaction, i kinda figured if he knew i were calling he would be round like a shot to start gathering up my stuff... anyway, i explained the situation, what id done today and where i was upto, laid on 3 options to him, 1 i requested politely he returned the warrant as the courts are willing to do the attatchment to benefits once he returned, NO GO he said if he did that he loses his fees, at the end of the day he says he is a self employed bailiff and its is wages, fair enough i figure, so i tell him option 2 is we arrange payment in installments of £10 per week, again no go, the handling fee for the debit cards are £1 per time and if he didnt do it that way he would be wasting time and petrol to get it by hand, option 3, the loan, tho i told him he would have to wait for it to clear which is 7-10 working days and tbh he said he doesnt mind waiting, hes taking what im saying at face value and understands the situation so he knows im not outright taking the mick.

                          im going to go to the CAB tomorrow to explain something to them that to be honest really is bugging me, I am happy to accept the fees if the court pulls the warrant, stick it on the bill and take it off the benefits, no problem, but it seems the court are more interested in keeping their pockets full of cash instead of helping us out. this is the government afterall, arent they supposed to look after their people? Christ im happy to damn near triple the bill so im hoping the CAB or the Law centre can manage to get the enforcement officers to pull the warrant and ill foot the bill, if not then its the loan.

                          But, thanks for all your help, i really do appreciate it. If you have any more advice i know you will put it up!

                            Hi im just at the begining of this process thanks for all of this it seems to me pay up or lose it mines for £440 with there fees included and i to have no way not going down the loan route as thats how we end up here i know it not a distress warrant with loans but it ends here with bailffes if we cant afford to pay not sure how im going about it yet but im not on the ele roll i do own the house but my partner is on the electorial roll just might stand a chance of the 180days lol offered him 110 a mth no go there
