  • Jacobs and Council Tax

    Recently been repossessed and have an outstanding council tax debt at previous address. My girlfriend (whose name the council tax is in) was in an arrangement with Jacobs and although she has been paying them she is a bit behind with it.

    A bailiff has called this morning and left a 48 hour notice to return and remove etc. Because Jacobs had been in the previous address, where the bill is for, are they allowed entry to our new address?

    Please help - we're sick of this hassle!

            The bailiff can call at your house at any reasonable time to seize goods, but you do not have to let them in.
            The bailiff cannot enter your house by force, but they can legally enter your property through open windows or unlocked doors, so make sure all your doors and windows are locked or closed!
            Once the bailiff has been inside your house by entering peacefully, they can call again at a later date and enter your house without your permission, forcefully, to remove your goods.
            When seizing goods the bailiff must leave the premises safe.
            When in your house the bailiff has the right of access to all rooms and can force their way into other parts of the property.

            Jacobs will lie and try to gain entry, there will probably be a mobile number on the letter, I think it would depend on who owns the property you are in and if you're girlfriend is owner tenant etc

            Had some dealings with these myself and there charges do not comply with charges set out Below, we have provided you with the amount of Statutory Fees that bailiffs should charge for the collection of unpaid Council Tax/Business Rates. Please note that the regulations do not allow for a bailiff company to charge a fee for sending you a letter when collecting Council Tax.
            The Statutory Fees they can charge, are as follows:


            First visit fee: £24.50
            This is for a first attendance to levy, but where a levy does not takes place. (For example; where you are not in)
            The bailiff can charge a levy fee if they levy, but he cannot charge both amounts on the same occasion.

            Second visit fee: £18.00
            Despite any further visits, the bailiff can only charge for a maximum of 2 visits.
