  • Marstons , clamped car, no previous knowledge of debt!

    Hi all, looking for some help with Marstons

    i had a phone call this afternoon from the wife ,crying.
    she said bailif has just been and given her a letter

    in which it states she owes the council 420 pounds
    which apparently is in relation to a parking contravention outside our house.

    she says she has no knowledge of this. But doesn’t deny it’s plausible, as there are zig zags opposite us and parking is a nightmare. But again, didn’t know anything about any fines or subsequent fines etc.

    she offered to pay in instalments what she could
    but she was refused and told it’s paid in full or he will take goods or her car.

    I called this bailiff and said listen , she has explained she knew nothing of this etc and offered to pay what she can etc.
    he argued back and forth eventually he said right because of my phone call he would go back and “do what i have to do” if she wasn’t gonna pay up.

    so he returned , clamped her car
    and added an extra 90 odd quid on for the privilege. And stuck a new letter through the door,



    none of these letters give deadlines to by by or any information other than they were intending to remove goods/vehicle. And to call them. They now will not answer our calls.

    looking for any advice really. We are willing to pay , but simply can not afford £513 in a lump.

      Hi Rob,

      no, the car is owned outright, isn’t used at present at all. And likely only worth £1500 or so

      Luckily all the other vehicles we have are in my name and/or financed.
      The Agent has not entered my property which does contain some quite valuable assets that not all I would be readily able to prove are owned by me and not my wife.

      she has no problem paying up , and if it comes to it I’ll just pay the money. But she wants to offer a payment plan to suit her affordability.
      We don’t tend ti separate finances or problems but on this occasion she is adamant that it’s her problem and she wants to resolve it by her own means.
