  • Threats to my daughter

    Hi I learnt recently from my daughter that she had paid in full to a bailiff company nearly £300 out of her universal credit (money she couldn't afford) after receiving threatening text messages from a representative, stating that that day they would be arriving at her flat that afternoon to collect payment or goods to the value unless paid in full.
    Then there was a ridiculous text from them later stating that because there was no payment straight away they would be around that afternoon with a removal vehicle incurring further costs.
    She at the time was in hospital with pneumonia due to asthma which they messaged back telling her they need proof, if not they would check (BS) and unless they get it they would proceed to her flat to take control of goods. And asking her what ward etc etc she was in and all other sorts of BS.
    Saying the hospital were unable to confirm she was there and they would complete recovery action that afternoon.
    Now you and I know this is BS but it was enough for her to make payment in full even though she couldn't afford that amount.
    She is registered as vulnerable which she told them.
    Also this is all logged as text messages from them with a company mobile number not withheld.
    Any retrospective recompense on this or can they just get away with this?

    The first thing to do is raise a Formal Complaint in writing email it to them. There will be a complaints procedure on their website. It seems that you have quite a bit of evidence i.e. the texts, your daughter being in hospital etc. Bailiffs have a Code of Conduct that they need to follow.

    Your daughter would have been classed as a Vulnerable Persons, the bailiffs should have known to stop collection activity.
