    An interesting defamation case in which the Judge exercised his powers under CPR 16.3(7) to determine that the Claimant was entitled to recover more than the damages claimed. The Claimant had stated on the claim form that he did not expect to recover more than £10,000 however, after hearing the case, the Judge awarded £140,000 and allowing the Claimant to retrospectively pay the higher court fee (yet to be determined).

    The statement of value in the claim form does not limit the power of the court to give judgment for the amount which it finds the claimant is entitled to.
