  • caught using my mobile device while supervising a leaner driver

    i was pulled over by traffic police officer , he states he was driving passed our cae and i was holding looking down using my thumbs for approx. 4 seconds 3 meters away from me.

    i am not 100 % i did have my phone in my and as it was back in December 23 .
    as one pint i did move my phone from the Centre console as it was in the way of the gear change . and put it safely in the side panel

    1- i have received my phone records which show no text or calls within that time frame.
    2- also the policeman who was who has written the statement was driving the police car and it was is college who witnesses this not him. but this is not mentioned on the witness statement as evidence to the court.
    3- i have seen i could possibly accept a lesser charge of not being in proper control of a vehicle but how do i go about this. and would the cps accept this
