    Hi this is Lily. I am putting it out there regarding Default Notices. Brief details of my situation:
    Date of Default Notice 3/6/202. I did not receive it in the post. Letter from Creditor dated 11/8/2021 to say, quote: "A Financial Conduct Authority information sheet on Default should have been included with this notice, which contains further information about your rights and where to you can find help and support. Unfortunately a system error meant that the information sheet wasn't issued alongside the Default Notice as it should have been"

    Summary: I didn't receive original notice dated 3/6/2021, only aware of it when 11August letter arrived to say about the information sheet not included as it should have been. Therefore my 14 day period to rectify things had been and gone between 3/6/2021 and 11/8/2021. So the Default Notice was registered on my credit file.

    Also I hadn't missed three payments by 3/6/2021. My history for 2021 was Jan- April arrangement to suspend payments inplace due to lockdown. These are not 'missed payments', 3/6/2021 Default issued.

    Is this Default Notice correct? I.e. followed correct procedure of issue in Compliance with Consumer Credit Act ??

    Can I have this revoked?

    Hi Lily

    a) Write a Formal Letter of Complaint to the Creditor (make sure you get Proof of Postage), explain what's happened, how it's effected you (your ability to get credit etc) and what you want them to do - invite them to remove the Default. Explain that if they don't remove the Default and compensate you, you will lodge a complaint with the FOS.

    b) Email the Credit Reference Agency, explaining what's happened, ask them to remove the Default.

    c) You could contact the ICO if you don't get anywhere, as there is 'incorrect' information on your Credit File.
