  • What to expect?

    Hello All,

    im bringing a claim against an furniture company and the court date is looming.

    I’ve submitted my witness statement and the defendant has submitted theirs.

    Where as I have quite a lot of evidence, the defendant has only attached one item.

    Are they allowed to produce more on the day, or are they not allowed and should i gain sight of all evidence prior?

    Also, should I be made aware of any witnesses that are presented by the defendant in advance, or can they just be called on the day?

    Apologies if these questions are rather stupid - I can’t find info about the process of a small claims hearing anywhere.

    Everything should be in their Evidence Bundle. If they want to provide further evidence, they would need the Courts permission in advance of any Hearing.


    Also, should I be made aware of any witnesses that are presented by the defendant in advance, or can they just be called on the day?

    Again, they can't just produce Witnesses, they should have stated the Witnesses in the Directions Questionnaire they were sent by the Court months ago. Again they would need the Courts permission in advance of any Hearing.

      Many thanks ECHAT11! I find it strange what little evidence they've produced. It seems as though they're going in with very little. They've basically produced a receipt that isn't even my receipt!

        The defendant has today settled and offered what I set out to get in 2021. Thanks for your advice!
