The Civil Proceedings Fees Order 2008 (As amended) says, (In the table in Schedule 1) "Where the claimant does not identify the value of the claim when starting proceedings to recover a sum of money, the fee payable is the one applicable to a claim where the sum is not limited."
What does that mean if the claim includes a claim for, say damages for mental distress which the Claimant wishes to leave to the discretion of the Court?
Does the N1 / CPR 16.3 statement that, for example, the claimant expects to recover, more than £10,000 but not more than £25,000, make the applicable court fee £1,250 (5% of the amount claimed) or would the £10,000 fee for unlimited claims apply.
