Non-molestation order

  • Non-molestation order

    I have received a letter to say my mother is taking me to court for a non-molestation order. This is to take place on 21st September at 2pm. In the statement she has said I have been intimidating her and turning up at her house. I have not had contact with her for since 19/04/2022 and even then, it was brief, mainly regarding my children (her grandchildren) I have removed and blocked all family members from all social media platforms etc. I am unsure what I do or where I go with this and wondered if you could help me?

    I applied for a non-molestation order against my parents last year after I requested several times they stay out of contact with myself and my children but they continued to try and contact my children, this application was pulled the day of the hearing by my solicitor who suggested it was for the best for me. On Thursday I received this order that my mother has taken out against me, in which she states I have been harassing or intimidating her, posting or publishing about her either in print or digitally, contacting her directly, and coming into her house. I, in no way have harassed or intimidated her, I have spoken with her a handful of times in the last year or so only in regards to my children who she began having access with again (which has again stopped as my children have requested not to see her) and I absolutely have never gone into her house because before Thursday when receiving this letter, I had no idea where she moved to. I also have to question if she felt threatened or harassed by me why she had not requested this information (home address, contact numbers) were not asked to be kept private, and why it is only her name on this order and not her husband or her sons (my father and brother) there was a fall out over a year ago, I have borderline personality disorder, anxiety and depression, I had become very very poorly and was taken to hospital, whilst finally on the road to recovering and receiving treatment I was advised to speak with my mother regarding my childhood. One of my biggest traumas was being sexually abused by my eldest brother (who has Down syndrome), when opening up about this with my mother she refused to believe me and stated it could be my medication basically messing with my head (I still have text messages as proof) she stated that my sister had spoken with her about him being inappropriate but he denied anything so she chose not to believe me. It was at that point I decided in order to get better and start recovery I had to cut this family off due to the toxicity of the environment. I'm not sure if you are aware of borderline personality disorder, but around 1.7 percent of people diagnosed with the disorder have been diagnosed due to childhood trauma. In all honesty, I just want this all over with and to move on with my life and have no further connections or contact with them.

      You are in a difficult family. Non-molestation orders are not the answer for any of you.
      A possibility is to make it clear that you do not accept any of the allegations (save where you do), and that you have no intention or desire of contacting them.
      All the court wants is to see you behaving responsibly. They do not want to referee your family from the sidelines.
