  • Attachment of earnings order in court

    Help anyone
    Have to attend court regarding an attachment of earnings order on a ccj dated 23/03/2015
    which was then served with a final charging order on 10/08/2015
    I thought it would be statute barred because of the time scale
    Mortimers say not so

    CCJs do not get statute barred;-

    When does a CCJ become statute barred? It never does. But if the creditor hasn't taken any enforcement action in six years, they will need to apply to the court for permission if they want to enforce the debt by using bailiffs. This is unusual but if it happens to you,

      Ok,
      So that means they cannot use the court to enforce payment?
      even though they have a final charge

        If over 6 years and no enforcement by them then they have to show the court good reason as to pursue =generally, and court give permission!
