  • Voluntary Termination

    Hi,

I'm just about to send the inital letter that is on here - and I wanted to check something before sending it. The lettter states that we should request a pick up date within 14 dyas, however on my agreement under Ending the agreement early, it states that I should return the vehicle at my expense (which I'm kinda prepared to do), should I amend the letter to state I will return it within a reasonable distance???

help please, not looking forward to this process, so fingers crossed.

    Thanks

    Re: Voluntary Termination

    Hello,

Strictly speaking, by returning it at your own expense you are incurring further expense and additional liability than is set out in the CCA. As you are generally required to return it to a car auction (which may not be the one closest to you) then you could end up travelling 100+ miles. If you are happy to return it at your own expense then feel free to amend it but reasonable distance is a bit vague and subjective. You may wish to say something like within a X mile radius.

I would anticipate push back from the lender on this either way.

Thanks Rob - looking to make this as easy as possible and thinking (hoping) that if I play fair they might too.... I think it's Manheim they seem to use and the closest to me is about 20 mins away. Just as it's in black and white in their agreement in seciton 11 I think I should maybe honour that?

      Thanks

        Re: Voluntary Termination

Like I said, there's no harm in you returning it as long as you are happy to do that and incur your own expenses. I would suggest that you take photos before you leave to return it and also before you hand it over to Manheim if that's who they are. There have been suggestions that the car is not always reviewed or sold straight away and can be sitting around for weeks or even months. This is why it is crucial to make sure you get good photos of the car all over, including nay scratches or dents etc. so you can compare in the event of a dispute.

          Re: Voluntary Termination

          Hi,

Just looking for a final (hopefully) piece of advice please - I'm taking the car to the auction next week as they have requested and have been told they will do a condition report - I've not seen one of these - do I sign it or do I refuse? What's best? There are a couple of scuffs - but nothing major at all, so wondering how that part ofthe process goes.
