    Hello,

    I have a debt that is about 9 years old. I took it out when i was young and was made to take out the loan amount in PPI.
    I did make some repayments, but the company went into administration and it was impossible to contact anyone.

    I have moved around a lot over the years and its been about 7 years since any contact was last made with the welcome finance. Last year i received a letter from a debt recovery agency, advising me that my debt is now with them. I haven't heard anything else since. Am I in a position to send them a letter regarding the limitation act?

    Any help would be greatly appreciated.

    You could just let sleeping dogs lie until or unless they write to you again if a whole year has passed since the last communication.

    If the debt really is Statute Barred then it won’t become un-Statute Barred.

    Shall I assume the loan was an unsecured loan?

      thank you for your reply - i appreciate your help.

      It was an unsecured loan.
      Over the last couple of weeks i had been getting small slips of white paper through my letterbox, saying 'urgent, please contact ...(a persons name and number - no company name was included). I got worried and thought it might be a bailiff, so this is the reason i wanted to find out a bit more information.
      I sent a 'limitation act' letter to the debt recovery agency that bought the debt and got a reply back with 'the debt is not statute barred, because the last payment i made was in 2011, however the claim was issued in 2013 and judgement entered in 2015' as the claim was made within the 6 years, the debt is not statute barred.

      I have checked my credit through Experian and also checked every address i have lived at to see if there are any CCJs using trust online.org, but cannot find any record of a judgement entered/ccj. is there something I am missing? or would Experian and trust online not show this information? any info would be appreciated.
