  • Received n30 judgement for claimant(in default)

    Hi,
    I've received a default judgement against me even though I attended the court hearing. On the judgement form it says I have not replied to the claim form which I replied and sent back to the court months ago. What would I need to do to correct this.

    Is it from the same Court? If so you will need to contact them. Did you get an acknowledgment they received it, can you prove you sent it?

      Yes it's from the same court,i received acknowledgement to say they received it and attended the court last Thursday for the same case

        What order was made by the court at the hearing?

          Hi, the order was to pay the full amount owed plus costs payable within 14 days

            If you have some money and can afford to pay the debt off in instalments, you need to fill in court form N245 to apply. This is called an application for an Instalment Order.

              Was this hearing the full hearing following a successful set-aside application following a prior default judgment ? (originally Welcome finance?) You applied to set-aside a judgment by default and won that part ( did you have an order stating the judgment be set aside?), were ordered to file a defence, then went on to lose the main hearing? If so I think it should be a N24 rather than an N30 so I would check with the court - the date of the new judgment should be the date of the hearing not the original default judgment date - is it? And you should now have the opportunity to get it paid off within 28 days to avoid it being put back on the register.

              However if this was the set aside hearing and it wasn't set aside then it would keep the default judgment status and the original judgment date, I believe anyway.

              If you want to you can apply to vary the order using the N245 form ( https://formfinder.hmctsformfinder.j...k/n245-eng.pdf ) , to apply to change from forthwith to installments (costs £50).
