  • Removing partner from property

    Hello. I had to call the police on my partner due to a domestic incident and I now want him to leave. I'm not sure what my rights are and the process to be followed. Any advice would be greatly appreciated.

      Firstly, hats of to you my darling for being brave enough to say enough is enough!

      No one but NO ONE has a right to make you feel bad, or lay hands on you. I don't blame you for wanting your former partner out!

      I am not sure of the process as when I was in this situation my ex owned the house, so I ended up on me toes with the cat! (yes I took his cat.. in my defence I took her to his mother's as he ended up in prison.)

      CAB suggest the following
      If your partner makes you feel anxious or threatened, you should get help.Don’t try to agree what to do about your home without speaking to someone first.
      You can call Refuge or Women's Aid on 0808 2000 247 at any time.
      Men's Advice Line is a charity that helps men suffering domestic abuse. You can call their helpline on 0808 801 0327 between 9am to 5pm, Monday to Friday.
      If you’re unsure about what to do next, contact your nearest Citizens Advice.[/SIZE]
      If you own the house I assume you could ask the police to remove him for you, have someone change the locks and go for a non molestation order. I am not sure what happens if you are co tenants. What I would suggest though is if you have be splitting the bills, call the company and say you are taking responsibilty from the day you decided your ex needed to go. That way if they haven't paid the bills, you have a clean slate. Any joint bills, ask to set up a payment plan you can afford, explain you know it might take longer but that you are going through this at present, when you are in a better finanical position you will call in and change things.

        Can you give us a bit more info? Was this the first time you called the police, has he been violent or abusive (including verbal abuse) before when you did not call the police? Do you have children or are there any children in the house? How long have you been together and if you have been together for a while is this behaviour new?
        You will get through this and although you may feel awful now it will pass.

          Hi,
          Scary situation for you but there is support out there.
          Do you own the property and if so how, is it in joint names? Are you renting, is his name on the tenancy agreement? Have you contacted your landlord if this is the case?
          Hopefully we can point you in the right direction to enable you to get back on track. Do speak to one of the organisations that the CAB recommend that Slainte Caragh indicated in post #3
