  • Return of Company car after dismissal...

    HI,

    I am currently in a position that affords me a company car and a mobile, I have just been "suspended pending an investigation" and may be dismissed. I feel aggrieved, and would probably not return to work for the company again anyway. My question is, how long can I maintain use of the company car and mobile?

    I presume that you have been suspended on full pay pending the outcome of the investigation. Whilst this is ongoing you should retain the benefit of the company car and mobile.

      Many thanks for your reply Ula, assuming that I am dismissed at the disciplinary, (glass half empty...) would I be expected to return the vehicle and 'phone immediately?

        If you are dismissed by was of summary dismissal or dismissal without notice, which should only be considered in cases involving acts of 'gross misconduct'. Then it is likely that you will be asked to hand back all company property there and then. If you are given notice to leave then you are entitled to your salary and benefit i.e. company car and mobile during the notice period.

          Many thanks for your response ULA, I have been dismissed for Gross Misconduct (I don't see it that way...) but I paid £309 towards the phone around 18 months ago. I will give back the SIM but surely I can retain the handset ulness they reimburse me?
